    1984returnsforreal - any court would expect a consumer to have an indication as to the expected market price for a product. That's just how it is. No need to call me sad is there. Especially where £200 is concerned - it's a lot of money to the standard member of the public and so any court would expect them to have looked into it before spending such a large amount of money.

    You honestly telling me you didn't know it was a misprice, that you thought £200 for a 42" LED TV was perfectly normal?

    I disagree with you.

    Pixmania (from what I found out after the fact) regularly sell advertising 70% off.

    That put a 42" TV at around £650-£700.

    Now that sounds about right to me... In fact that still sounds a lot of money.. I should imagine many MSErs can point out 42" TVs for less than the above.

    Thanks for your concern over what a court would find reasonable or not reasonable.

    & yes. If you spend your time looking at what models have just been released & what they are worth without actually looking to buy I find that especially sad.

    I've had a message from a member stating that the guy advertising about taking class action (possibly a solicitor, but can't find post) may be going ahead with a claim. So possibly it is feasible, but a bit more complicated than say the B&Q cases.
    Maybe worth contacting the guy if you are dithering about claiming - it would certainly make things easier, though not too sure of cost, if any.

    The Legal dept of Pixmania in France are starting to reply. Looks like the extra time was to do their legal work.

    However, the clearly forget the Clause 5 Rome Convention which affords the UK buyer the UK contract law (they claim UK law doesnt apply). They also claim the order was never accepted by them (despite their validation!).

    Also they said anyone buying the TV would know that LED is new technology. Well I don't know, technology isnt my forte but when they have filled the sales page with "time limited offer" and quoted the discount, they paint a wonderful picture.

    If you want to stick in a claim, go to the lossofbargain.co.uk site, the info is there to begin.

    They ask you to write to France. I still disagree, there is a UK registered office and you need to serve court documents to a UK address. I somehow doubt they will be going all berets and onions when it comes to defending and given the daily poke around the website by Dixons UK, I can safely say it is very much a UK concern

    The "story" I got was it was only a possibilty of group action and they were still waiting on the insurance to cover costs to be clarified.

    Ah, Lynsey, your stupidity is what caused alarm bells to ring in the Pixmania office. Don't you understand that multiple quantities were bound to raise an eyebrow?     Yes I blame Lynsey for destroying the whole operation, her and about umm 27,000 other placed orders, You thought Eurovision would raise a flag.

    You believe that then, I believe NONE would have received their original orders as it was a misprice, a misprice which would have cost them thousands, and still may.
    The chance to get your order may still be an option, BUT you need to put in the effort.
