oh that's good news. what about if they pay you at the lower rate when otherwise you wouldn't be entitled to anything? do you then have to pay them back?0

Yes they do. When I won my Incapacity Benefit back on appeal they calculated what they had paid me in the reduced rate income support and what I would have had in Incapacity Benefit - they then paid me the difference - and it was lovely and such a relief to receive that - there was almost 5 months to come back to me!oh that's good news. what about if they pay you at the lower rate when otherwise you wouldn't be entitled to anything? do you then have to pay them back?
Im not sure on that - but if you hadnt been entitled to anything then you would have to surely pay it back - though I think that would be very rare. You would probably then only have to pay it back in installments anyway - but not too definite on this!Weight Loss - 102lb0 -

I assume you mean if you get reduced Income Support and then lose the appeal. No, you do not have to pay it back.0 -
hi, following on from my last post, we have sent in the appeal, and today my son received a giro, does that mean he will get this every 2 weeks until his appeal?0

I would have thought that the giro is for backpayments but am not too sure - is he not getting it paid into his account? My payments with the exception of one or two have all gone straight into my bank account - the only ones not doing are the ones when I kept ringing them and said that I needed the money they had in backpayments - so they sent out giros to be going on with.Weight Loss - 102lb0

As Helen said it is probably the back payments, you will probably find future ones will go into the account his usual benefit had been going into.0

We ranfg up the IB people whilst we were having two weeks in England (after they had had the forms for three weeks) and they said the'd got a huge backlog and haven't looked at them yet. However, they did tell me that if my husband had to have a medical it would be with an English-speaking Doctor in Malaga.
Will report back when we know more.(AKA HRH_MUngo)

I am new to this forum and have only lived in Spain a few weeks and have been reading peoples comments with interest.
I hoted from one of Max's postings that there can be delays in getting reviews carried out!
Does anyone know if this means that in the meantime your payments stop until a new decision has been reached?
I ask this in the context of delayed processing of IB50's and/or arranging possible medicals in Spain etc.
My review is not until next year but I want to be prepared, i had hoped that the UK Overseas benefits office would know that you just buy your repeat prescriptions over the counter and do not regisitor with a GP as in the UK...
Should we attend an English speaking doctor 2 or 3 times per year so they know of us?
Any help or info from anyone will be greatly appreciated as one of my many problems is anxiety.
