Thanks everyone, I managed to see someone at CAB this morning. They said they can arrange a DMP free of charge. We are expecting an appointment that will come through the door to see a debt advisor who will explain everything to us.
Does anyone know if you can be forced to sell your house through doing this?0 -
to get a charging order on your house they have to go to court and it is not as bad as you may think, as even with a dmp as long as you make your payments they cannot touch you.
it seems like you are not trying to evade your debt so once you get a dpm you should feel better0 -
Thanks, that is good to know! It is actually my mam's debts, I am just trying to sort everything out for her, it's all getting too much for her and making her ill. She is so upset that she could lose the house. It has never been about getting away with the debt, even with the unenforcable one. MBNA gave her credit for 18,000 and she doesnt even work, she is a carer for my nana. What were they thinking? She has been taking money off the card to pay the bill. To top it all off, they have been charging her more interest than they should have. They just need to come to some sort of sensible agreement. They want us to make a payment of £300 a month, it is impossible. I just hope the CAB can sort it out in time as they could be taking further action by the end of the month.0

This might be a daft question, but what did she do with the £18,000?0 -
Well most of it went into paying for itself. It has just been building up for years and got out of control. When there wasn't enough money at the end of the month, she took it off the card. Its silly really but at the time, she just done what she could to make ends meet. They had a big loss in the credit crunch, they had their own taxi and lost it. Things went downhill from there0

MoJ reacts rather than being pro-active.
There are now so many claims companies with no real regulation (all it takes is an application where you agree to behave a certain way and you are up and running). The MoJ is shutting them down but they start up again on a new name.

I had a call in July they have charged me £844 on my August statement and I have not heard anything since have called several times only got through once sent in an official complaint in October I asked for a response or a refund of the fee still no response have an online advisor but they are never online
I did recieve a letter claiming if nothing can be done then the fee would be refunded0 -

The amount is currently frozen and I am making one final attempt to contact delete.0
