Sony's eula gives them the rights to apply the update themselves, so they state, so in fact you don't need to agree, or update, they can change it from their end if they choose to, if you ever go online.
Although it could be argued that is you bought it to be a game-playing, online, iplayer-using, blu-ray player with linux functionality and that the shop assured you that that is what you'd get, then it doesnt matter what sony's EULA says. If you were taking it up with sony, then that's one thing, but taking it up with the retailer will be another matter entirely. You buy something before ever SEEING the EULA.0 -
Engadget are reporting that a Forum Moderator over at NeoGAF has successfully clawed back £84.00 from Amazon by invoking European directive 1999/44/EC.

Good on the moderator for getting money back, but the EU directive is not law; it is incorperated in law in the Sale of Goods Act (probably among other legislation).0 -

exactly the point,they are penalising those with legit machines and allowing the hackers/modders to have the better deal0 -
UPDATE
Sainsburys will refund all of my money, when i return the console , they agreed with me totally , no arguing at all .
I will send it back , its made me think twice about purchasing something like the sony Ps3 which can have features removed in a forceful manner , optional update .
Anyway sorted now , THANKS TO ALL THE PEEPS WHO ADVISED ME .0 -

Sainsburys will refund the purchase price if you have the receipt.
I took a digibox back after 11 months, which didn't work anymore. No quibble, full refund. Really good customer service.
(It may change on PS3's "not working" with linux though once Sony explains what it means)
