  • I unfortunately a victim of the so called Company Unfair Credit direct.. paid unfront fee of £695 in good faith of the promise of 1x loan and 2x credit cards being written off... received letters and communication from the company so thought that they were legitimate... sadly NOT.. 15 months later and lots of phone calls to various people at "the company" I have received a letter saying that basically are debts are after all un enforceable.. and that the company is not closed (as of day after letter received!)...

    Does anyone now whether we can claim any money back? or have we just got to except we have been conned and ripped off?!!:(:(

    Just like the companies lent you the money in good faith. Didn't stop you trying to get out of paying it back, so why are you feeling the victim?

    I have spoken to the Ministry Of Justice and basically it ain't good news, I have also spoken to the company who is dealing with the liquidation (Bridgestones who can be contacted on 0800 999 0666) It looks as if they are in the clear and they won't have to pay us back anything, I bet their directors have had a pleasant time with our money! The directors need to be tracked down and subjected to humiliation or better still prosecuted and spend time at her majesty's pleasure.

    hi i am new to this forum, i totally agree with you,they should spend time at her majesty's pleasure indeed. i parted £967 with John Weir of unfair credit and he told me that there is nothing to worry about, my debt WILL be written off. I went on board with unfair cred in Aug 09, to this day not one out of my 3 unsecured loans were written off,they were just fobbing me off saying everything is going fine and it wont be long they will be written off,before i knew it i received a letter dated 11th Oct 2010 blah blah blah will cease trading from 11th Oct.
    I am very angry,i parted with money that i did not have and i want it back,i do not like being ripped off by a long shot,but there are scum out there who will rip off innocent people like us.:mad:

    Whilst I sympathise with what has happened and agree these claims companies are scumbags, you cant really accuse them of trying to rip off innocent people like you. After all, you were trying to get out of a legal debt. They were effectively a dodgy company looking for dodgy consumers with no morals. You would not have been ripped off if you were innocent in this.

    These claims companies play like an episode of Hustle and what do they say on that; you cant con an honest person.

    They promised refunds if cases were not successful and this is stated in their agreement, so how did they propose to refund their clients. Also, surely the barristers should still be working on the cases ? Barrister agreements were signed by UC clients for them to proceed. From what I understand the agreements can still be made unenforceable if 'true' agreement with the correct terms is not produced ?

    Letters were sent out from UC after the court case last year stating it was "good news" after the ruling. Any thoughts??

    Hi does anyone know WHO and WHERE these barristers were based etc.unfair credit told me that my paper work was passed onto their team of barristers,i asked one employee Shirley where are these barristers,she said that they will contact me, to this day since Aug 09 they have not,and by the looks of things never will.
    I received a letter from unfair credit dated 24th may 2010 states,unfortuanetly, our barristers have informed us that they are unable to proceed with your case in the normal matter due to court proceedings, as you had defaulted on payments,if, however you decide you would like the barristers to present you in this matter this can be arranged separately but there would be a fee of £500.

    unfair credit told me from the beginnig that in total it would only cost me £967 of which i paid by installments,they told me to STOP paying the creditors as the loans i had were 100% unenforceable,that i did.
    Because of this one of my creditors have put a charge on my home,the so called local judge some how changed the unsecured loan into secured,the creditor did not have the original agreement.Thanks for nothing unfair credit direct!! .

    Would this be that much different to when you borrowed a load of money from your bank and promised to pay it back? Seems you are happy to rip off the lender but squeal when somebody does it to you. I believe in some circles it is called Karma.
  • i would not say that i am happy to rip off the lenders,the debt was left to me after my divorce of which this debt has been going on since 1995,32k!!. i could not then afford to pay what these creditors required each month,that is why i went to unfair credit to get these unsecured loans as promised by them to be written off, now i will be paying this for the next 10years or so with reduced payments. i agree that i owe them the money but at the moment it is not easy.
  • I have a feeling I too have lost £895 to these low-lifes. My wife and I signed up with UCD March 2009, on the basis of 'secret commission' paid when we took out a loan with Alliance & Leicester in 2003. The last update from UCD when I called them on 1st Sep was they had received documentation from the lender and were in the process of a full audit and would prepare a letter of claim within 2 weeks........ On 13th Oct I receive a welcome letter from CCGB. Lots of blurb saying our claim would be unaffected. I got a CCGB client welcome pack in the post today. There's a Form of Authority to sign, along with a letter to authorise for the Data Compliance Officer at the Alliance & Leicester (needs a £10 release fee). I don't know what to do now. The one chink of light is with their terms & conditions. There are changes between those from UCD and CCGB. In particular, gone is the "....we offer a full money-back guarentee." It now reads "...we may offer a full money-back guarentee." Would I be able to pursue a refund on the basis the terms have changed? Would the MoJ be interested I wonder? I guess these terms are probably not worth the paper they're written on....Ho hum.

    My wife and I signed up with UCD March 2009, on the basis of 'secret commission' paid when we took out a loan with Alliance & Leicester in 2003.
    Unfortunately, that was another bit of "wishful" thinking by claims companies. If you paid a fee and a commission was paid and the commission was not disclosed then you have a good case. However, if it was commission only or fee only or both where the commission was disclosed then you dont have a case. If you didnt use a broker then you never had a chance. i.e. if you went direct to A&L then there is no "secret commission".

    The one court case that ruled in favour of the consumer on this ruled that the commission should be repaid by the broker to the consumer. It was a couple of hundred quid. So, most claims companies never bothered as it isnt economically viable to complain and go through the process. Paying £895 to get around £200 back (assuming you used a broker for the loan and paid a fee and the broker got paid a commission and didnt disclose it) doesnt make any sense.
    Would I be able to pursue a refund on the basis the terms have changed?
    UCD are dead and dont exist anymore. Authorisation Surrendered 18/10/2010

    So, if you sign up with CCGB then you are agreeing new terms with a new company (even if there are links).
