My partner took my car to kwik fit today to have the back brakes checked. After taking off the back wheel on the drivers side they proceeded to take off the back wheel on the left however, as my partner did not know where I kept the wheel lock for the alloys kwik fit put the wheel they had taken off back on. Later that day whilst doing 70 mph on the motorway in the fast lane the wheel flew off. Whilst the wheel hub was scraping along the road, the brakes failed. Luckily he managed to weave through the traffic and pull over onto the hard shoulder and eventually came to a stop. Road rescue were called and the car was taken back to kwik fit who apologised and offered to sort the car out via their public liability insurance.
My partner notified my insurance company whom informed him that, if for any reason we did not want to use kwik fit insurance to let them know. Now by the time I arrived home and called my insurance company Aviva formally Norwich Union Direct - they were closed. Now I am adamant that I do not want kwik fit to touch my car again, but am I entitled to claim compensation. I am pretty sure that if I was driving the car things would not have ended as they did. I would not have had a clue what to do if my brakes had gone and the hand brake ceased to work. My son was in the car and this could have potentially been fatal. I will ring my insurance company first thing but can anyone tell me - what are my rights. I feel that what kwik fit have done is disgraceful and a repair and apology is not enough.

Whilst the wheel hub was scraping along the road, the brakes failed. wow one rear wheel hub scraping allong the floor causes the whole brakeing system to fail! i find this hard to believe you would have front brakes surely!
My partner notified my insurance company. by this i assume that your insured sole'ly on this car and he on another or is named driver on your policy. i am surprised they actually spoke to your partner as he isnt policy holder! and if he's insured on another vehicle i hope he has checked that he has the correct policy in place to allow hime to drive other vehicles third party cover! if they spoke to your partner this may be breach of data protection if he is not insured on it or policy holder! and he has to contact his insurance as he was driving your vehicle as he was involved in the incident NOT YOU.

I feel that what kwik fit have done is disgraceful and a repair and apology is not enough. so what do you want them to do then? why is it unfair to offer a repair and apology? why is this not good enough? a judge will ask the same if it got to court!!!!!
but am I entitled to claim compensation !!!!!!! no YOU are not as you have nothing to do with the incident!!!!! would your partner probably not! no injuries occured (as i assume as you havent said anything about injuries).
i also find it hard to believe that the tyre comeing off on a busy motoway didnt cause an accident or someone didnt plow into the back of the car whilst he was gaining control, the car would of been all over the place (fish tailed) as the wheel hub/chassis/axle/bumper/possibly petrol/diesel tank would of been grinding the tarmac and pulling the car in all sorts of directions at 70MPH!! he managed to pull the car over on the hard shoulder, sorry but traveling at that speed with no brakes panic shock adrenalin and a wetness in the pants would of planted him straight into the banking or another car, barrier and then hospital. then your recovery takes the car back to kwick fit!!! not home! next youd be saying they slapped a wheel and tyre and bolts on for you get home!!!!
the amount of damage that "incident" would of caused to the car i doubt very much your recovery service would of taken it back there! you didnt say the aa or rac or green flag so i assume it to be a local garage/recovery. if it was the aa they have designated centres and kwick fit isnt one of them (nationwide autocentres are though)

I am making no assumptions you stated it was not possible, it is not only possible it does happen and I explained to you how it does happen, with very basic material science.
You calculations of odds, whilst interesting, have no basis in fact and seem plucked from the air, if the studs were old, fatigued or of poor quality then all 4-5 would be, if the kwik fit fitter torqued the life out of them he would probably do so to all 4-5, and once one let go the rapid multiplication of force on the remaining bolts would then trigger the domino effect.
To suggest that this would need all 4-5 to independently fail without understanding the obvious relationship between them is worrying for a mechanic.

You lack of belief in basic physics is quite strange, and whilst you may have put wheels on for 23 years it does not qualify you as a metallurgist.
