ok, on the original letter (which I kept a copy of) I managed to switch two of the digits so for example instead of account number 12345678 I might have put 12346578.

    I have just noticed this

    Do you think I should

a - start whole proces again, sending £1 with a new CCA request AND the correct credit card number

b - send the chaser letter above anyway, quoting the correct account number

My concern with B, is in court whilst I would have the chaser letter correct the orgiinal letter clearly asks for a 16 digit credit card number which doesnt exist......gulp I am so annoyed with myself

    yours,
    mrs (UN)organised!

Start again, get it right from the beginning.
  • have done - thank

new 12+2 commenced today - sent recorded delivery for CCA4

CCA1 - enforecable, so paying this months payment now

CCA2, CCA3 unenforceable , sent offer Never template letter stating so by recorded delivery and managed to get the money back from CCCS so I can distribute those funds to other debts :j

  • Hi

I have had a reply back to my most recent request for a CCA

We apologise for the delat in responding to your request under section 78 for Consumer Credit ACt 1974. We will write to you regarding your request in due course.

We note that your account was acquired from another lender some time ago. As such we need to obtain documentation from that lender; as soon as this is received we will forward it to you.

In the meantime, you should continue to make payments to your account. We believe that this is consistent with the egal position (as recently confirmed in the case of McGuffick v the Royal Bank of Scotland plc) that, even in circumstances where a lender has not complied with a request under the Act, the lender can continue to demand payments be made to that account, and any arrears will be reported to the Credit Reference Agencies and the use of any card(s) may be withdrawn

We acknowledge some of our customers, cqn fall into financial difficulty....blah blah blah blah..

    so what next, do I

    1 - ignore,pay nothing and sit tight?
2 - write back saying as you have failed to comply I wont be making further payments?
    3 - do something else?

    advice appreciated

    thanks

Morning, have today received a NOTICE OF SUM IN ARREARS

this basically just shows I havent made two payments and has lots of gumf on it.

Do I ignore? Is this the same as a default on the account?

    Thanks
