    well the postman brought a 4th cca from MBNA, but its for an old account opened in 2001, totally different account number to the one I requested. I have phoned them and they have confirmed the account they sent is closed. They suggested my letter must have had the wrong number on it, I explained calmly I had a copy of the letter sent by recorded delivery in front of me and I have quoted the correct number, and they have failed to reply. The lady couldnt say much and couldnt confirm whether the CCA was being looked for, had been sent, and she couldnt send a message saying the wrong one had been issued

    Me thinks, that I need to write to them re the 4th account stating they have nt complied with my request and 12+2 has now elapsed,

    you guys agree?

    i agree, send the reminder letter.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies

    I refer to my letter dated XX/XX/XXXX in which I made a formal request under the Consumer Credit Act 1974 (CCA1974) s.77-s.79 for a true copy of the regulated agreement refered to in the above account number. You are reminded that you are obliged to supply this under s.189 whether you are the original creditor or not. I also enclosed the statutory fee of £1.00.

    To date you have failed to comply with my statutory request and have defaulted in respect of this account. Additionally this alleged agreement is unenforceable until such time as you come out of default or enforced by a court of law. It is a further offence to attempt to enforce this alleged agreement until such time as your default is revoked.

    Consequently I am ceasing all payments to your company until such time as this matter is resolved. It is also my intention to report this matter to the appropriate enforcement authorities.

    I agree, I won't bother adding in they sent the wrong one, you requested account x, they sent account y. They legally have to send you account x.

  • ok, on the original letter (which I kept a copy of) I managed to switch two of the digits so for example instead of account number 12345678 I might have put 12346578.

    I have just noticed this

    Do you think I should

    a - start whole proces again, sending £1 with a new CCA request AND the correct credit card number

    b - send the chaser letter above anyway, quoting the correct account number

    My concern with B, is in court whilst I would have the chaser letter correct the orgiinal letter clearly asks for a 16 digit credit card number which doesnt exist......gulp I am so annoyed with myself
