ok, I shall, I have 4 debts with them - and they have frozen interest on them as I am on DMP
By doing this, I should withhold payment? In which case I should assume they will start issueing additional late payment fees and interets etc etc, I am not worried about defaults as I have several now
so CCA 1 - was taking out post april 07, so I have to pay it
CCA2 - we have covered, I will follow your steer
CCA3 - shall I post it here or start a new thread??
thanks0 -

Ahh never knew you were on a DMP - they will not deal with unenforceability. It may be best to wait til you have all 4 CCA's back before stopping payments and sending any letters - lets just see what they send back.
Nah, keep everything here and post agreement 3 up for us please2010 - year of the troll

Listen to NID on the CCA info, he knows his stuff, [STRIKE]we[/STRIKE]he wrote the guide
I was just quering points.
I also agree, if on a DMP with national debtline, CCCS, PayPlan. They will not stop making payments to those creditors, in there eyes they just see it as you owe the money (which legally you do) so will continue making pro-rata payments to them until it is paid in full. A bit draft really, work on the enforceable debts first.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -

yeah on DMP with CCCS, have been thinking of leaving anyway as I have had to move 2 of my debts out of plan, and pay seperately as cccs basically insist on pro ratatring payments which meant that in nearly 2 yrs one of my creditors has been charging me £100 a month interest and receiving £108 payment, meaning I have paid £150 off a £6k debt, and I will be about 200 years old before its cleared.....so I have taken out to pay £20 a month, and get defaulted etc etc
anyway I am rambling
Number 3 for your guidance0 -
whoops....here it is

When was this taken out?
Can you confirm, page 1 - personal details down right of page, did you hand write this? have you blacked the info out? or was it sent to you blank?
Are all 3 pages linked to the same card? If not please confirm what is
Is there a lender signature on the actual CCA alongside yours? You have to be certain on this so check everywhere for a stamp or something....2010 - year of the troll

ok, this is a seperate scan to the previous one, seperate card. Taken out 2005
I have blanked out personal details on right of page, which were filled in in my handwriting in block capitals...it was
name
dob
previous address
mortgage payment
tel no
mobile tel no
priority no (that was I think some reward scheme with hotels)
job title
employer
work no
legth of service
salary
household salary
bank details - sort code, acc no, tenure
password on account
yes at the top is someones name, which I thought was strange I have blanked this out, if you want to see original I can perhaps pm or email you direct?
I have checked the back and other sheets of paper they have attached (including terms and conditions) and there appears to be no sign of a credit limit anywhere0 -

Hiya
Ok forget the credit limit - this really doesn't matter on its own.... however i'd go as far as saying send the same letter to both. They will come back saying they disagree, great - we want a final response. When they do that it is in stalemate at which point you confirm this (i'll provide the letter) and then forget about them.
You will be left with the defaults, but you will not have to repay any money.2010 - year of the troll

omg....I iwsh I had done this 2 years (and about £6.5kto mbna) ago.....
anyway, I have a 4th account, but as yet they havent replied to my request sent on 19th March, we have had easter and the others only arrived on friday - saturday, so I think I should wait rather than send the non reply letter just yet?
finally on the letter you gave, where you say sign digitally, is it ok just to type my name, or do you mean somehow to scan in a signature (sorry if this is a daft question)
thanks0
