I'm not sure if that was a slight on me but I'm guessing it was and I don't disagree but life is all about experiences and if someone posts on a forum then they will get views of the experience of the other posters....whether rightly or wrongly

I also think it is very important to be made aware of other peoples experiences as it gives a 'real life' perspective on any given topic.

It can also offer hope to those who feel they are in an impossible situation and also a reality check to those who misinterprate or misunderstand the situation they may be in.

Opinions, however, are another matter, but that is what is so good about these forums - yes - we can all have differences of opinion at times (well, many times in some cases), and you will alway get the occasional Troll who is always god for a laugh, but as a relative newcomer to these forums but with many work related experiences to share, I have also learnt a lot over the short time I have contributed and I hope that I assisted or encouraged others as well.

    Sorry for drifting off topic.

Did you win and was it worth the stress?

Its a yes and a no, I took an out of court settlement without liability being admitted, but at the same time a colleage had been sacked, she won her case but only got 1/4 of what I got.

It was a long hard struggle, emotionally, mentally, physically, the compo was equivalent to 6mths wages tax free, so I had some damm gd holidays.

But becuase I resigned I then had to prove that the company were at fault, (without going into full details one of the members of the company recieved a police caution for what they did). Soit should of be clear cut.

If your dismissed, its actually easier, as the company has to prove that they did everything right.

In yours / ur gfs position I would look at the following routes.

Speak to Acas about her rights

Look at joining a union, she doesn't have to pay out of her wages, she can pay direct debit

She if your union can give her advice (long shot)

If you live together / not 2gother, check to see if you have legal cover on the home insurance policies, - I've used that service been brilliant,

If I can help any way, just pm x
xx rip dad... we had our ups and downs but we’re always be family xx

Not me who asked the original question, I was just interested in hearing whether going through the process and whether it was worth it.

Also from the companies side 6 months wages isn't that bad (dependant on what you earn obviously!)

Apologies, never looked at name. If my 1st solicitor had done the job properly I would of been looking at 50k+ loss of wages, tax credits based on wages, and bonuses.... but wasn't meant to be!

But 6mths wages, couldn't turn nose up, pd some bills, had some damm gd holidays and enjoyed them. x

Thanks again everyone, some very positive and helpful comments (mum2one you're already a star), forgot to mention (sorry i keep adding bits but as its the hot topic at home the last week, new things keep coming up), she was suspended at the end of her back to work interview for being off sick, but was suspended for the text. The text she sent (which she admits to) was sent in either late Novermber or early December, why did the company wait to spring this on her? and was it right to do it on her first day back, at the end of her return to work interview?

Thanks again everyone, from both me and, well, was going to say better half but hey, she's not exactly girlfriend of the month material at the moment!

If work had suspended her during her time off ill you would be moaning that they were heaping the pressure one whilst she was off on the sick......

They want to get rid of her due to her sickness absence. And her behaviour by sending the text hasn't helped.

Also due to her illness she may have been behaving less than ideal at work.

The reason they delayed talking to her about the text is companies don't do well in legal situations harassing those on sickness leave if the sickness turns out to be more serious at a later date.
    I'm not cynical I'm realistic :p

The other girl might not have told them about the text until now. That would explain the delay.

A tip with regard to unions - normally they won't represent anybody until they have been a fully paid up member for 3 months, however, some branches can be flexible and will allow you to pay 3 months subs at once so that you are covered immediately and can seek representation.
