Another little update,
Well today they will have received my solicitors letter :eek:
Its a shame we have had to go down this road but they are just ignoring me obviously hoping it will go away
A few more interesting things to note
My warranty and service book is for a completely different car how i never noticed that straight away i don't know
The service plan voucher is for a 2009 car with 1,000 mileage !!
Its registered with the Dvla as a 2010 model,
But i now have written proof it was built in 2008
when we checked the pedal re-call site and it said the car was a 2010 model the dealer is saying thats the registration date , well thats very interesting because when we checked that site i still had the dvla registration form so the car should have not been registered then

TBH at this point i would of drove it back and asked for a refund under soga right in the middle of the reception as load as i could so all potential customers can overhear the convo!
these days you just cant win with some dealers and all their interested in is the comission for finance when you have a problem its oh we'll sort it go to the service bay and book in and im sure they just put it in the parking bay not touch it and say its done a few hours later. makes you wounder with some dealers why the head of departments and some up the top people at the dealers dont drive the cars theyre suppose to represent. like a fiat dealer near me the guy who owns it drives a honda accord and his staff drives honda jazz's? the rep cars and advertiser cars are all in the compound?0 -

Sorry to say it but you don't have a chance at winning this battle!
Just look in you V5 under vehicle details:
Under section 4 Vehicle Details:
line B: Date of 1st registration
(B,1) Date of first registration in the UK
Just because your car was assembled in 2008 it's still marketed and sold then registered for that year 10 plate 2010
your warranty commences after date of 1st registration
To be honest and as I've been in the motor trade for a number of years there is NOTHING wrong with the car sitting for 2 years before being sold.. and this happens all the time otherwise you would never get a car you wanted.
What happens when you buy new parts for your car do you really thing they were manufactured that week?
You have to firstly give the dealer a chance to fix your faults with the car to your satisfaction before anyone in the legal system will touch it!

Late 2009 may be acceptable but 2008 is not especially when that is the cars affected by the pedal-recall

This thread is an utter waste of peoples time, as a customer you should buy a product armed with enough information about the item, the market, warranty, build information, dealer and manufacturers practice not be be surprised by discovering your car is '08 build.
There is no excuse in the days of the internet to be surprised by finding your car was made 14 months ago.
Everything CDVehiclesolutions states is perfectly correct.
If you really want a factory fresh car tick a couple of options boxes and quite often they will have to build the car to your specification.
I could have had a 'new' 2009 convertible immediately but having chosen a couple of extras I now have to wait for a nice man in Sweden to build it for me and understanding the market I got a 6.6k discount by ordering it on the last day of March.
It's difficult to not come across as holier than thou but before parting with a large amount of cash you should have done your homework........it's too late now.0 -
The fact it's been sitting around, on it's own, is not enough to reject the car.
However, with the way you have been treated, lied to etc by the dealer (who is liable) I would say you had a good claim you have been mis-sold to.
I would go through with your threat of legal action; they'll never let it get to court.0
