    Well, it can't hurt to call them... as long as they are unbiased and they should be!

    Ring the AA and ask them about it.
    See if you can join now, and if you do will they help you. It'll be worth £30 or so for roadside cover to get the legal advise.

    A little update for those interested,
    The Dealership was Totally in the wrong for passing me onto Toyota GB, Under the Sales of goods Act It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.

    Toyota Customer services were a waste of time basically they said the car had a 3 year Warranty ( :wall:) Gee i didnt know that !!!!!
    They also said...
    Given that your vehicle was manufactured in Japan, I am sure you will appreciate that it takes a number of months for a vehicle to be shipped and then prepared for the UK market.
    In other words they couldn't care less and i suppose its not really there problem or is is !!
    There web site for checking your car for the pedal-recall has my car as a 2010 IQ2 and not affected ... but the list of dates for cars affected goes back to 2008 and does include mine so has it actually been checked ?

    Trading Standards and consumer direct think i have a claim for Misrepresentation, they were quite good but don't really dig deep enough, its like they find 1 possible answer and thats it but at least they give a good start

    Anyway i have spoken to the Principle at the dealership given him a few facts and he is getting back to me tomorrow to see if he accepts my rejection of the car

    If not i have had some Excellent Legal advice and will be taken it down the Legal Road

    Im not driving the car its parked up on my drive , im driving a Van:rotfl:

    Why don't you get in touch with one of the motoring magazines, What Car or Auto Express.
    They have articles on customers being ripped off buy manufacturers and garages, see how you get on tomorrow and keep in mind the power of the media.

    I'd try and get it into writing that they confirmed the build date as 2010, then take send a letter stating your intention to take them to court for failure to deliver.

    A contract does not take to be a formally written and signed agreement, and I would take them saying its a brand new car to MEAN it's a brand new car.

    This isn't a new telly or computer - it's a huge sum of money and you should get Exactly what you paid for.

    As for servicing a vehicle - you say you arent too happy about getting work done in the future at the dealers in question -
    If you are short of garages in the area - have you checked whether your local ambulance service has a fleet servicing workshops near to you? They can do private customer vehicle servicing too
    Don't try to teach a pig to sing - it wastes your time and annoys the pig
