Yep i am with Next on this, they really do have a duty to report this each month. They need to be consistant, sorry but you just have to deal with this and accept it.

Some of the letters in THIS THREAD could help get the markers removed but it could be a long winded and tricky process on top of everything else you have going on and would wholly depend on if next have proof that an agreement existed between you in the first place

I'm assuming you've now cleared the balance with next so the usual moral implications of this approach (which is used by some as debt avoidance to get debts written off and is generally frowned upon by several on this forum so I'm probably about to get shot down in flames for mentioning it) shouldn't apply

Thank you for that link, unfortunately it will be tonight before I can get a better look through it, but thanks. And you're correct there is no outstanding balance.

For those that are with Next on this, can I remind you once again they are NOT DUTY bound to report or keep on their reports anything, it is purely at their discretion & as I have said if I owed them money they would use that information to do a deal, there is certainly no moral ground they are up-holding here, but that's fine, if some people agree with what Next are doing they are free to do so as I am free to disagree & believe they are a money grabbing, morally redundant shower of barstewards. (sorry but my language has also been suffering a crash course) Personally, I will never forget or forgive their whole attitude to this, to me it's pretty much as low as you can go - but just my opinion of course.

On another note get in touch with your local social services to ask how you go about getting an assessment for your mother with regards to her personal needs for a carer. They will be able to give you all the advice you need about having a carer to help look after her.

I understand your anger, however some people have principles such as "you let one off everyone else will want off as well and what is the point of having credit check then".

The situation is very difficult, but believe you me there is lots of people out there who can claim just "oh, it was one off, it was bereavement, depression etc etc etc" - fact is that situations like these are avoidable.

Your principles are just different to others. Doen't make them bast****.

Swearing and loosing it will not help.

Out of curiosity (and don't take this as criticism) is it possible that you might have come accross or been interpreted by Next as being a bit abusive on the phone? It's just a bit unusual that they have refused to take any more calls from you and told you they will put the phone down if you call again. Did you lose your temper at them? That might explain their reluctance to cooperate with your request.

Just a quick reply as I have to go & see how much money, help & whatever else there is going I can get out of the NHS.

I did not lose my temper with Next I was extremely polite & it wasn't until I broke down in tears that they wanted off the phone. Experian have been extremely understanding & they too find the behaviour of Next "questionable" but I can assure you I was nothing but apologetic & polite to next, if not slightly distraught given the circumstances.

I guess everyone could start claiming all sorts of things to get reports removed & they do & are successful in doing so, I don't see how that affects anyone else or where the harm in it is. Until this I was, luckily, ignorant to what goes on in the world of credit. Finding out now that some people have had negative reports removed from their credit (& in some cases involving thousands) does not bother me in the slightest, I fail to see how it effects anyone else. I don't believe in flogging someone just because I can.

Anyway, I told them I could provide medical evidence, reports from her doctor whatever they needed, but no the bad person was late paying £36 & they have the power to make me suffer for it & they will, simply because they can.

Anyway, as I said I now have to go & see how much I can milk out of public funds.

Baveno, I think you're going to do more harm than good by continuing to stay fixated on this situation with Next. The bottom line is they have the right to report factual information and they have their right to take the hard line. If the guys at the top have made it hard and fast company policy to do just that, you won't get anywhere other than more stressed by carrying on down this road.

Take a look at my first post on page 1 of this thread for some useful tips in regard to public services ;)

In January I realised I had missed 3 x £12 payments to Next. I immediately phoned apologised & explained my circumstances & paid, I have no outstanding credit on it. I don't have any other store or credit cards & have never missed a mortgage payment in my life. These missed £12 payments weren't because of money but down to the trauma of everything & just not thinking about Next.

    hi
can i start by saying how i cant imagine what your going through and hope you and your mother can get to enjoy what time you do have left together

now just something that got me thinking if the above is true and you dont have any other credit i think that may well be why the mortgage company has refused, because if they were to look and they arent taking into account anything other than what they see they will see you have one store card and yet you havent managed to cope with paying that on time, that in these times is probably going to worry them as they would expect someone with little to no credit to be paying it fine if your asking them for more money. You really cant blame next it is there policy to report missed payments, if they let you off why should they not let the next person off.

please dont get offended by this or by anything else people say we all have our own opinions, mine is that next were right to mark it on your file

most of all i want to say is that you need to stop dwelling on it as it will only end up stressing you and may make you ill and then what use will you be to your mother

    take care

Yes I am sure that is why, I've explained the reasons for the late payments but they won't shift on it, apparently recent late payments are one of the worse things you can have on your report whether it's for 50p or £50,000 it is treated the same. But I agree they are just as bad as Next.

This is just rubbish - absolute bullsh1t. A late payment on your file is not an issue at all.. 3 in a row means your file has a 3 on it, which is 3 months late, somewhat different and much more serious. That's a quarter of a year you haven't paid.

In respect of obligations to report the late payments - well I feel they do! Other lenders are basing decisions on the information - they PAY for the service, you don't. It's for their direct benefit not yours (although you benefit indirectly of course).

You have no leg to stand on, you have your reasons, but you've missed 3 months in a row on an account. You get the bill sent to you. There's no reason to forget 3 months in a row. If you're not opening your post then tough tits really.
