ins will only replace one chair? is this right!

hi,
pls help my house was flooded last week with dirty water from next door.
their kitchen is against my living room and the water belive it or not came right through the walls (i've always said these houses were built on a friday afternoon in a race to get to the pub ) anyway i have now found out that i paying up to double the insurance of friends But and this is the best bit as it may have been contaminated water the ins company took away my leather chair (i was left with a 3 seater ,2 seater and a footstool) today a loss ajuster has been to see me and said that they will only replace the chair and MAY give me a % of the rest of the suit (he made it sound as if this would be a favour).
please can someone tell me if this is right cos at the moment i now have no carpet,no wallpaper,no skirting boards and no nice cream leather chair only a noisy dehumidifier and very noisy blowers for the next 4 weeks.

    Tip: Get yourself a policy which has unlimited cover, like M&S/Halifax.
    I used to be insured with NU and they stitched me up like a kipper over a leak which caused untold damage to telly/computer/clothes, you name it.
    They paid out £75 to redecorate the room (then deducting the £50 excess!) and they sent some 'men' round to 'repair' the electrical items.

    I had a claim a couple of years ago and had by then switched to M&S. Their service is just brilliant. I had a gas leak in the house, we got the leak stopped by Transco, and so they had to smash the living room wall to get to the pipe. Within a week Carillion (the contractors who do M&S work) had been out, replastered the whole wall and then their decorator redid my entire living room, including glossing (which he didn't have to do but was booked out for 2 days work from them! lol).

    You have to pay a bit more really though and I've seen a similar policy from the Halifax which covers just as much and with whom I will be bartering this year's premium against M&S!

    Complain to the insurer at the treatment and just take your business elsewhere!
  • the thing is i didnt even know it was with royal sunalliance untill now when i took out my morgage some 15 years ago,i just bought all the bumff that the principality sold me with it !!
    i pay now £38.00 a month for what they say is a maxi cover plus policy (supposed to be their best,i just dread to think of their worst)

    Would seem reasonable to replace one chair if that was all that was damaged and if you can get a suitable colour match. This may me difficult with a leather suite so you could refuse any offers and see hoe you get on.

    Not sure if you could sure your neighbours for the uninsured losses.

    Most policies have a matching items/sets exclusion so I don't think you have been treated unfairly. Price-wise have you shopped around in the past?

    I think that you are jumping the gun somewhat here.

    If only one item was actually damaged and it can be replaced with a like for like on the rest of the suite then there is nothing wrong with it.

    If of cause the suite has been discontinued and there is no matching chair available then you will need to raise this with your insurers as you are not in the same possition as you were before the incident.

  • no i have never shopped around (nor have i claimed before) as i assumed that what i was sold to me was the best policy that was on offer.
    the suite has been discontinued so there is no matching chair available.
    i really dont want a New suite out of this,but i just couldnt afford to add the extra £2.000 it will cost me if they just buy me 1 chair.
    I have been told by the ins company that they will counter claim of my neighbours ins and if and when they win the claim they will reimburse my £100 excess.

    Do you have buildings insurance with them too? Why aren't the carpets covered for example? I suggest you contact the financial ombudsman and have another look at your policy documents to see what they say.

    yes i do have building covered with them as well.
    i havent started talks over carpets with them yet as i apparently need a dry certificate (which is going to take about 4 weeks)first then the loss adjuster will come back to discuss (try to get out of paying for) "floor coverings"

    We had accidental damage to a sofa and our insurers direct line said they would only pay to replace the sofa. As the suite had been discontinued by M & S and it was a cloth one so hard to match, I complained and they checked their records and said that as we had been with them for years and never claimed before they would then cover the cost of a replacement suite.

    If it was the neighbours fault surely you should be claiming off thier insurance, preserving you own no claims?
