My version:

- unenforceability seemed the best option

yes i am guilty as charged, apologies for my absence, lots happened this past week or so, and truely need to email you but i know you are so busy so was really trying to get everything done in one full hit like ann did on the start of this helpful thread of hers, well my mad thoughts were in one hit i wont be taking so much of your time - that was the method of my madness:o
anyway im so glad ive got to this thread and really happy for ann that you are on the cases you really are a wonderful person to help us all out

Glad to see everything's ticking over nicely.
For those who don't already know, if you have made no payment towards a debt for 6 years (5 in Scotland) or acknowledged the debt in writing then the debt will be statute barred and unenforcable (unless there has been a court judgement).
NID is quite right though that you should first get them to prove that the debt is owed - it's not unusual for DCA's to go after people with the same name or who lived at a previous address. If you just say it is statute barred, then they may assume that the debt is yours and will just harass you regardless. Get them to prove that the debt is owed, that it is to the person named and then you can throw the SB at them.
Jinny, hope you can get the power company sorted out.
NID - with regards to this (and i only ask because i don't have a clue about what is or isn't accepted by them), would they accept a standing order rather than a direct debit? That way Jinny would be in charge of how much can go out of her account. I know power companies don't have the same reputation as DCA's but DD's put the power in their hands. (pardon the pun)
Try not to sweat the letters not coming mouseann - it's not necessarily a bad thing. They have 12+2 days to reply to a CCA request. If they fail to reply within that time then the debt is officially in dispute. According the the OFT debt collection guidelines, they aren't supposed to enforce the debt in any way while the dispute remains - including adding interest, charges or trying to collect payment. (Okay, so almost everyone ignores the guidelines, but they're still there) Not getting the replies on time actually puts you in a slightly stronger position - and if you do get any more coming through, they'll probably be so old that they're either unenforcable or they no longer have the original documentation as it was from so long ago.
SW - you take care of yourself. Don't let anyone bully you - they can only hurt you if you give them permission to do so. Does their opinion actually matter to anyone but themselves? I doubt it, so don't let some waste of space fray your nerves. They're not worth it.

Regards to arrears on things like council tax/mobile phones/utilities - if they have already sold the debt PRIOR to any possible judgement then to get them to back down you need to give them the power, thus I say only a DD is really valid.
The thing is when the proposal is sent they will confirm and respond in writing, remember with an SO you cannot claim it back - with a DD you are actually in control due to DD Guarantee. Basically the proposal will be confirmed with a payment schedule notice - if the company averts from this agreement then the DD Guarantee would allow a claim for full refund.
See where i'm going with this? You need to give the creditor the power, in a sense, so they agree to your request... it shows commitment and desire to do what you say. Anyone can stall by making an offer, a DD mandate is a firm offer until such time the payment declined...

The utility companies are also regulated alot better than the DCA's making any refund much easier to get. Guess i've been reading too many threads about the DCA's and how some of them treat DD's.
