Ok, you do know any PPI/PPP refunds are always used to off-set the existing balance and only the remainder would go to your bank account..... so if you owe £3k and are owed £4k you'd get a grand, not the whole £4k....
Yes, the good news is that the PPI etc is for the car loan which was paid off in May last year, so it will be all mine!A smile costs little but creates much0 -

Well sorry I cant get on here everyday but love to catch up when i can. I still havent posted my dca letters yet as I mentioned earlier I cant even afford the ink for my printer untill this week when I get paid. I had another phone call from a dca today but as they were calling about my £200 overdue electricity account I thought I had better talk to them. Niddy quite rightly advised me on his enforcability thread to pay these as you need utilities. The muppet started off ok, but got my wee wee boiling by acting god like and said I would end up with no electricity and they could force entry into my home. He also had a habit of talking very fast and end each sentence with YEAH! he became louder and louder as he insisted i pay in full. i offered half this month then half next month but he said this was not acceptable. A member of my family had to listen in as i informed the caller i had him on loadspeaker cos he was talking so loud and fast. He kept interupting me when i asked him to listen to my statement (provided by Niddy lad) that i was not prepared to communicate by phone and under section 7 data protection act to remove all numbers held. I am with my family members help, going to clear the debt this week, but just thought it would amuse you all with this account of how these muppets do not intimidate me any longer. And very impressed with the way in which you are dealing with these muppets! The bloke from the electricity company sounds absolutely awful!
Hope you manage to get your printer ink sorted out soon. Have just had my postal delivery for the day (it arrives very late here!) and no more replies to my CCA requests. You have come a long way girl, lots of hard work but well done The muppet was from a debt collection agency that the leccy company had hired to intimidate me I be will ringing the leccy company up on payday this week and complain about the "heavies" they set on me, to do their dirty work. Its only £200 for goodness sake. I am going to clear the debt, then inform them that i am changing providers due to their agents bullying tactics. They wont care likely but will apease me somewhat”Pour yourself a drink, (tea for me now)

You tell them - I am sure that they have had much more than £200 from you over the last few years! They don't deserve your custom!
I have actually avoided the phone calls (so far, at least!) so I think you can take more credit for dealing with this sort of thing than I can.

Oh yes he was a character alright. About three times during the shouty conversation he put me on hold with awful jazz music (a loud trumpet playing) he he!:rotfl:remember my poem about fighting the dragons well i just read that while he pretended to get in touch with the leccy company he must have walked round his desk about twice before getting back to me. Ok, time to name and shame
1. What is the company called?
2. Are you formally in arrears or like missed one quarterly bill?
3. They cannot cut you off
4. They cannot send a bailiff
5. You have rights and any legitimate offer MUST be accepted (this is unique to utility companies)
6. Set a monthly DD for the arrears, say £20 per month for 10 months
7. Consider complaining to the regulatory body (OFGEM) and claim compo for the harassment and intimidation
8. Formally complain about the staff member and note the time and date of the call as added proof - they will pull the recording and hear for themselves
If that fails come back to me and i'll sort them for you - no worries2010 - year of the troll

Righto Nids so you dont think i should pay in full. It is a long standing debt so is a full quarters amount I failed keep up with the arrangement I had with them. He did say when I was trying to issue the statement that it was no longer nessessary to issue the statement as he was passing the debt back to N Power and that they will send me a pack to go through my income and expenditure with a fine tooth comb to see why I cannot pay the debt and they can only arrange payment plans. The DCA company was CCSL I do not have the callers name as he spoke too fast but called me today at 11.29am”Pour yourself a drink, (tea for me now)

On the subject of uneforceablilty, could I have your wisdom.
I support families of murder victims outside of work and one of the issues which always come up is dealing with debt. Now for the most part, it is reasonably easy especially if I have been given 3rd party authority. However, I am currently dealing with a young mum who out of the blue got a letter from Carpquest. Once I had the 3rd party,they said it relates to a CC debt from early 2001/2, forgot to make a note as I was so shocked at it appearing so late. Anyway, when you consider the amount would have involved costs and it still only comes to a little over £1k, it could not have been big to start with, but she should never, ever have been given a card. There are literacy issues involved so she would not have been able to understand what she was agreeing to, plus, again as a result of the literacy issues, unable to work so only income is from benefits. It is quite funny as Carpquest phone me and ask to speak to her, but as I know her with another surname, I have always hung up when I realise who they are looking for! Bet that cheeses them off!!!A smile costs little but creates much0 -
