However, I am currently dealing with a young mum who out of the blue got a letter from Carpquest. Once I had the 3rd party, they said it relates to a CC debt from early 2001/2, forgot to make a note as I was so shocked at it appearing so late. Anyway, when you consider the amount would have involved costs and it still only comes to a little over £1k, it could not have been big to start with, but she should never, ever have been given a card. There are literacy issues involved so she would not have been able to understand what she was agreeing to, plus, again as a result of the literacy issues, unable to work so only income is from benefits. It is quite funny as Carpquest phone me and ask to speak to her, but as I know her with another surname, I have always hung up when I realise who they are looking for! Bet that cheeses them off!!!

    Hiya

Can you clarify - you're saying this is for a debt from 2001/2002 and not in the name of the woman you're dealing with? She has confirmed to you that it was not her account? OR are you saying it was her account but she didn't know what she was signing up for?

Either way, the debt would be statute barred - so long as she never paid for a while. Can you stop speaking to them, thats the main thing. Then try and establish date of last payment....

If they have a different surname, why? Has she got married or was it a mistake at their end? In any case, i'd be prone to blag it and accept nothing until you send this off and get a response: You know nothing of the Debt / Prove It

The more info you can provide me the easier this is to sort.......

    Hi Jinny,

Looks as if Niddy is on his white charger coming to your rescue. Where would we be without him?

I do hope you manage to get that muppet told off (or preferably sacked!)

No wonder this thread has turned into the Niddy Appreciation Society!
Yes hes great isnt he - I dread to think what these people do to severly depressed or vunerable people. We know we messed up we know we owe money but no need to beat us up verbally in the proccess. N power agents tricked their way once into my sons flat and conviced him he was best with them, he ended up paying two companies! I had a right job getting his money back he didnt want me to complain as he is ill as you know, good job he had me though not everyone has a carer to look out for them.

Righto Nids so you dont think i should pay in full. It is a long standing debt so is a full quarters amount I failed keep up with the arrangement I had with them. He did say when I was trying to issue the statement that it was no longer nessessary to issue the statement as he was passing the debt back to N Power and that they will send me a pack to go through my income and expenditure with a fine tooth comb to see why I cannot pay the debt and they can only arrange payment plans. The DCA company was CCSL I do not have the callers name as he spoke too fast but called me today at 11.29am

    Hiya

No you do not have to pay in one go - the moment you make an offer to N Power they resume ownership. Are you still with N power? If so do you pay your regular supply by monthly payments or full quarterly bills? Have you changed suppliers?

What date period is this debt for? Give me info!!

    Right NID's

She has an Islamic name so when Caprquest phone they use her second name as her surname. Still the same person, but me being bit slow off the mark when they phone, so I have only spoken to them once about the debt which was when I found out what it was.

She remembers taking getting the card but I doubt very much if a payment was ever made on it. Sadly there are alot of things forgotten as she is concentrating on the kids.

I think it is blag it time and get it scrapped. They are a complete pain in the proverbial.

Had to deal with a CC company for another client and wrote to them so that I could establish what needed to be done. At that stage I didn't have 3rd Party and my letter to them explained that I knew about the Data Protection Act so guidelines I could pass on would be appreciated. Was gobsmacked to get a phone call from someone a bith further up the food chain who said that sometimes the Data Protection Act needed to be thrown out the window and could they write to the client via myself to say the balance had been written off. What a wonderful person.

Have just looked at the web page. Wonder what they had to be become DCA of the year - highest number of people intimidated/best scare tactics used?

And I can't really get to grips with cutting and pasting these quotes!

    Hi Jinny,

I am sure NID will have his usual words of wisdom, but it does sound unacceptable to me!
