Presumably they can only "take" things if I get taken to court, the judgment goes against me and then I default my repayments? (I have been reading a bit about it!)
Only thing is, what happens if a DCA (i.e. a non-court person) visits and they see my car? Are they able to try to threaten to take it? I have no finance on my car - it was bought a few years ago by an elderly auntie (even older than me!) so that I could drive her around. Sadly she died about two years ago but the car was always in my name - she just paid for it! Would it be as well if I parked it away from my house if I think they are likely to see it?
And there is no way I would let them into the house! Perhaps I should put on my "little old lady" act and remind them how old I am?

They can only "take" things if they get a court order - this cannot happen without an original agreement (see my signature)....

Do not worry about this, see point above. If they wanted to try this they would have to write and annouce their visit at which point you fire off template 13.3 and then move the car round the corner or on a friends drive (thus results in trespass if the DCA tries to do anything) for a few weeks.And there is no way I would let them into the house! Please dont worry Ann. Trust NID. He knows what he is doing. Have you seen how many people he has helped. I didnt see anyone crying. They all seem reassured and secure. Please realise you are in safe hands. He is like an Angel. Sometimes it get's so stressful but you are safe now.
PS if it gets really bad. Come and visit me for a break.

Ok, if they (or anyone) for that matter happens to ring you then you need to interrupt them (after passing security) and recite the following (at the bottom of the post), word for word - if this means you have to pause, then continue, but make sure you do it!
Just so you know, all outbound calls by banks and DCA's are recorded, therefore if you fail or refuse to answer security they will say whatever they like (be that rude or wrong) because recording does not take place until you have passed security and they have your details in front of them - however the moment you do pass security and they start to discuss the "account" (also recording at this point), you then recite the info at the bottom of the post, then hang up!
This is your legal right and you are utilising it, if they then continue to harass you we'll have em fined and put to task for breach of OFT Guidance and Protection from Harassment Act.
Obviously you're not recording the call, but you need to convince them that you are!

Apex work for my Lloyds overdraft so i can just ignore letters now cant I or will it lead to a ccj? Just bear in mind overdrafts are CCA exempt so you're kinda blagging this in the hope they issue a default notice, when they do it will be wrong and we will then use this against them if they try for a CCJ... though it is unlikely on a small overdraft, however the main point here is that you cannot hide behind the CCA(1974) as o/d's are exempt in that respect (i.e s.77/s.78).
You'll be fine, so long as you keep me updated, then you'll always be one step ahead of them, pre-empting their next move....2010 - year of the troll
