I think you will find that for people in your situation the non enforceable route is popular, and recommended by most on this board. The banks have brought this on themselves by their usurious charges and by the way they increase interest charges as the first sign that an individual is suffering financial difficulty.

Stick with it, I am sure it will be difficult and there may be many sleepless nights, but far less than if you had not sat down and faced up to the situation.

    Good luck

I'm confused, one side of you comes across really nice and caring but the other side of you contradicts almost everything you say on here, and other boards.

It was only the other day I seeen you post on here for the OP (Ann) to contact me, which she did by the way, but then on another thread you were [STRIKE]taking the p!ss[/STRIKE] - sorry, mocking Unenforceability and calling people names for utilising it. If you remember my 5000 words essay response to you?

So please, help ease my confusion and tell me are you for real and genuinely care about others or are you here just to mock and wind us up? It won't take long for people reading my message to go and search your previous posts to see what i'm on about.

One example is where you called it a loophole and another is where you hijacked a thread (lordash) and thought it'd be funny going on about borrowing at 0% to extend your swimming pool.

Now call me cynical, but how can you refer people to me and then in the next breath slate us because it is against your beliefs?

Sorry mate, but I do think you need to decide where your loyalties lie as i'm confused as hell right now *insert confused smiley 20 times* :D

NID, just a small techy question so hopefully not going to make mouseann concerned about this.

The Barclaycard letter, would it not put them in a weaker position by waiting until the 12+2 days had passed before replying so that the debt was officially in dispute before pointing out their error?

Hi George - well done you - and well spotted - :T :T

I forgot Ann only sent the CCA Request off last week..... so yea, Ann - hold fire til at least 21 days have passed since you sent the CCA Request - this way the account can remain in dispute for a further 28 days thus, as George correctly pointed out, weakening their position - we never stop them making mistakes, we need to let them make as many as they can, i.e. if it was to go to court then you'd be able to show that they have no respect for the laws in place, nor for following procedural processes - this all helps you. :D

Don't send it til 21 days have passed, thus making them 7 days in breach of your s.78 at the point you send the letter on previous page. :p

    Thanks again George

Mouseann, i totally disagree with your comments about NID!!!

Let him sort out the banks? The first thing he'd have them do is write off all debts that don't have a properly executed credit agreement. He'd put most of them out of business :rotfl:

Ooooer, you know me too well :whistle::whistle::whistle:

NID sort out the banks?? Doesn't he spend his working hours looking for their mistakes? Or have I got that wrong?

LOL, I think you're missing the irony of it all - in "sort them out" it means like kick but! Not sort them out to do things properly :rotfl: :rotfl:

    Thanks (again) NID,

Have made a note of when to send the letter - I had it already to send but hadn't printed it off yet, so will just change the date!

I am being very scrupulous with my record keeping, as I appreciate how important this is. In fact, it is almost like having a full-time job!
