    Thanks Happyhaddock,

    I do feel so much better now! For some reason yesterday was a partiularly bad day for me - now I feel much more in control.

    And I am going to keep posting, because the help and support I have received has been overwhelming!

    You're right mate they will not offset unless you are in arrears - however the notion of sending in a CCA makes them concerned and it has been known for them to freeze accounts and/or remove funds - so best to be safe and send the HSBC Group CCA's last, once the Co-Op is opened etc....

    If you have any money that you can take from the cards - spend it now! Use up to your limit prior to posting the CCA (sod morals).... but seriously, yea - pension and state benefit is protected against being offset but only once you have proved to the bank, sometimes you realise it's that much hard work arguing that it's easier to let them keep that lot of money and move afterwards..... bummer but same old catch 22 :D

    No need to do this at this stage, lets not confuse matters eh?

    Too many cooks and all that! Simple process to follow now is:

    1. Cancel PayPlan
    2. Send CCA's
    3. PM me when you get a reply

    That's it - nothing more, nothing less.

    Reclaiming charges is a waste of time on an unenforceable debt, why do it? You aint paying anything back and any refund is counteracted against the original debt - not like they pay it to you. In essence, it doesn't matter if the debt is £10k or £1k - if it is unenforceable then that's that - dead and buried.

    Also a sar costs £10 - x 17 cards = £170 - waste of money. Send the CCA request at this stage. :D

    Regards to HSBC - no, they will not do anything cos whatever they do, we'll fight back and stop it. They will not get a court order, if they did sneak one in, we'd get it set-aside - there are processes to follow, the moment you send in a s.78 (CCA Request) the account is in dispute and that gives you 28 days to await info - no action can be taken on a disputed debt. Assume HSBC and First do come back ok, then we agree to repayment plans with them only - but usually i'm good at finding simple things missing in terms so lets wait and see before worrying ok?

    Don't worry - all will be ok, you're in safe hands :D:D

    I have been reading your posts with interest, and I just wanted to say, that you are in very safe hands now, and that my faith in human nature has been really lifted. Thanks to all you good folk who have/are taking time to help mouseann. I think you are all marvellous. Good luck mouseanne, and look to the future, because it seems to be a whole lot brighter than it was a couple of weeks ago.!

    Thanks yet again to everyone - especially never-in-doubt,

    Have been doing so more gardening - hence the silence.

    Have also sent off the letters apart from the HSBC linked ones.

    I think my sense of humour is gradually coming back - because when I was outside I mischievously visualised the headline "little old lady of 65 defeats the big banks"! Not sure I am really a typical "little old lady" though the age is undeniable - and I can't take any credit for this, as I was in a real state just 24 hours ago!

    Not going to get complacent, though. Think I have learned my lesson on that one, although it was more a question of burying my head!

    And what would I have done without this forum .....

    Put it this way i'll be gobsmacked if out of the 17 accounts listed, more than 4 come back enforceable - I know which I expect to be, but still - thats a lot better than 17 isn't it?

    So, i'd say you will be beating the banks - you just don't know it yet! :D
