Seems about right to me. With the possible exception of the first part.If you don't stand for something, you'll fall for anything0 -

Have you had many phone calls this week, Ann?
Over the past 7 days I've had 30 calls off Barclaycard and 21 calls off Capital One!
Do you think they are ringing to tell me my CCA's are unenforceable?0 -

That's it now mate - they have now broken varying acts/laws, send this - and make sure you send it recorded, so you have proof that they know your intentions:OFFICIAL COMPLAINT UNDER THE CONSUMER CREDIT ACT 1974 / 2006WARNING - IMPENDING CRIMINAL PROSECUTION
Dear Sirs,
Account No: XXXXXXXX
I have on numerous occasions, informed your company that I am unwilling to communicate by phone and also notified you that all phone numbers listed are to be removed from my personal details.
I have also asked that all correspondence should be in writing only for which, under OFT Guidance on Debt Collection, you are to obey any such reasonable request. I have sent you an official warning by way of a 'Harassment by Telephone' letter which is dated: xx/xx/xxx, a copy of this such letter is attached for your perusal which also confirms and proves that I have given you ample opportunity to cease this unwarranted and illegal harassment.
The frequency of calls received from your organisation have been recorded for independent adjudication and I hereby place you under notice that if I receive any further calls from your organisation on any telephone number you have listed against me, I will take immediate legal action against you. Similarly; if you continue harassing me via intimidating phone calls, I may without further notice ask the court for permission to bring a private criminal prosecution against the directors of your firm.
I hereby formally place you under notice, s.7 DPA(1998), thus you must immediately and without delay update your records to reflect my request to remove all telephone numbers listed notwithstanding the major fact that I do consider your actions to be a significant breach of the law.
I reserve the right to seek an injunction against your organisation should the phone calls continue at the same frequency and I similarly reserve the right to bring a formal complaint against you to OFCOM, the Police, The FOS, the FSA and the OFT along with any other relevant regulatory Bodies. Further, please note that this letter constitutes a formal complaint and, should I not receive a satisfactory response to this complaint within 7 working days from the date of this letter, I will seek adjudication from the regulatory organisations noted above.
Yours faithfully

Give them the allotted 7 working days from the date of this letter, and then you should consider seeking an adjudication from the regulatory organisations.2010 - year of the troll

I already sent that to Barclaycard a few weeks back, they just sent back a letter saying they are looking in to my complaint and we hope to resolve it by the 20th May.
I sent Capital One the other harassment letter and they replied saying they were looking in to it too.
I expect Halifax to start ringing next week too.0 -

Yeah, I guess i've just proved that I'm narcissistic enough to search for my name - or am I just checking my posts for replies? I can see you're keeping busy!
I did know a few people there who I thought were nice enough people but I wouldn't want them knocking on my door in their professional capacity.
Being serious for the moment for anyone reading about bailiffs, even the nice ones have a job to do. I wouldn't even want my own brother to trust me if I were to turn up on his doorstep on that job... I'm glad I did the job because it was a big eye opener for a naive computer geek but I'm even more glad I'm back in computing once more.
But they won't turn up without a court order being in place first...If you don't stand for something, you'll fall for anything0 -

Doesn't matter mate - you have to send it again like tomorrow cos we'll actually prove a point if you're happy to be the guinnea pig? We'll show everyone how to get an injunction against a lender - could be funny?
hehe - its up to you, but personally i'd be sending that letter again and even add a line saying that they called you "" times in one day whatever to make the fact ring true.
Reasonable collection activity is maybe one call at home, mobile and work in morning, lunch and night (=9 a day) - not double figures, which is harassment in every sense!
Fancy some fun?2010 - year of the troll

Thanks for confirming this - as I was explaining earlier to Ann - so as long as s.127 prohibits a court order being made, there cannot be a court appointed bailiff knocking on your door - thus anyone that does has no legal capacity to be there and you can have them removed by calling 999.
I know what you mean about them doing a job mate, but hey - sometimes they take the mickey - for instance on this thread we're speaking with older ladies and if I hear a baliff tirns up at any of their doors i'll personally throw the book at them.....

The numbers were over the course of a week, not just for one day.
Saying that if you think it's worth having a go then I'm up for having a go!0
