Thanks NID,
Much appreciated.
From the head gossip!
How are you today - after your driving mis-hap yesterday then? have you sorted those pesky insurers?
Have I got this right that you were led to believe you had a £100 excess and now that you need to claim they are saying it is £300? For that to happen, i.e. such a change, they would have to send you a new scedule of insurance or what is more commonly known as a new Insurance Certificate. They cannot just amend the excesses as they see fit as this affects the actual "loading value" of the policy. i.e. if you pick a £50 excess you'll pay more than if you pick a £1000 excess. Therefore you are the only one able to make such a change - not the insurers.
I'd be prone to claim and change insurers - or formally complain and mention the bit above to them, they'll soon get the idea you know what you're speaking about2010 - year of the troll

But how do you spot/identify trolls? Do you have a flowchart?
Or it is a secret????
Nooo, you know what to look for..... they usually come on spamming threads or trying to wind other people up. We just kick them into our thread so they can stay there whilst we control them pending admin kicking/suspending their access.
It keeps the rest of the forum clear, so to speak!
Spammer is someone that would post about fake shoes, in a credit card thread. A troll is someone that would start calling you names, on here - for no reason, for instance. I see a lot of it as I am the lead unenforceability man - i.e. I love people to utilise their rights under s.78, so I get a lot of "do gooders" trying to troll my threads calling people horrid names etc, for no real reason. A long standing user will not behave this way as they will appreciate that you have your own opinion - they may disagree but they will not resort to name calling. newer posters, sometimes do.

Hi NID,
Don't think I described the insurance issue very well! It is a bit of a saga - and you have done so much for me re the CCAs I really don't want to take advantage of your good nature!
However, the saga is - I have had an insurance with Marks and Spencer for several years. I chose them because I also get breakdown insurance - home, roadside, relay - for a really good price. They use the RAC.
However, what I didn't realise was that M&S are only a broker. Last year in February a dozey old git went into the back of me - I obviously claimed on the insurance because it was totally his fault! The excess would have been £100 but because it was very clear cut I did not have to pay. This insurance also included free car hire for the duration of the accident.
Therefore, when I rang them yesterday to report the Polling Station "incident" (and, unfortunately, this was my fault - the other car was stationary!) I was informed that, when I renewed my policy in July 2009, the company M&S used had changed. Which meant that the excess had gone up to £300 and it also appears that I do not have the entitlement to a hire car. (I only found out that from the repair place today!)
When I got out all my documents yesterday I did notice in the small print that the excess said £300 but who reads the small print? (I am sure you do, and have probably earned a telling-off for saying this!)
However, I do feel that I should have received a separate letter from M&S informing me that
1. My underwriters had changed - from Fortis to NIG.
2. My excess had trebled.
3. It appears that I have "lost" the entitlement to a hire car.
My complaint letter is going to tell them that!
Might not work, but worth the price of a stamp!
And I will definitely be changing this year - only problem is, I will have to declare yesterday's accident.
Anyway, I am fine thank you. Tired after the marathon telly-watching last night and annoyed about the above.

Thanks NID,
Makes perfect sense!
I am just envisaging you zapping all these messages during the night - and we don't even get to see them!

Hiya
You're right. The FSA (which insurers are also governed by) insist that they use clear english and to be fair, a stongly worded letter of complaint should help - if they reverse your complaint back to you - being that you should always read the policy - then you can look to complain to the main governing body FSO - http://www.financial-ombudsman.org.uk/publications/consumer-leaflet.htm
Good Luck!2010 - year of the troll

Thanks
I know I should have read the small print! But that would only have made me realise the excess.
To be fair, when I moaned at the Call Centre people yesterday (funny to be actually talking to a Call Centre!) they did say they I should have been sent a letter and they would refer it to the Customer Services Manager. I am going to put it in writing, though (I am learning all the time!).
Hadn't thought about the FSO - that will be my Plan B.

Ooops, its actually the FOS lol - been too long and I still forget! hehe
You cannot formally complain to them until the insurer has issued a final response, think the same process as banks and you'll be alright. But yea, complain and complain quick smart!2010 - year of the troll
