    People who are having problems did you order loads? I havn't had time to read through all 37 pages but I just wondered if it's easier to be 'nice' and refund a customer who hasn't taken the pee? Not debating the legality of it all and I hope you get what you want, but having worked in cs roles whilst studying it's a lot easier to help friendly people and people who don't seem greedy... Please note I said seem greedy - I'm not accusing anyone of anything - just wondering if that could be playing a part in the different approaches?

    so....important bits
    prices on our Grocery website are guide prices only. The actual price you pay will be the price charged in store at the time your order is picked for delivery
    in other words....the guide price means nothing....you pay what price it scans at instore on the day
    There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you
    so they do apparently accept on dispatch...although this doesnt make sense as they are then committing you to buy the items at an unauthorised price.....when paying by debit card you can only authorise a set amount (where DC's and CC's differ) so I dont see how they can class that as contract formation when youre not informed of the actual price....perhaps this is the 'loophole' needed to discredit Tesco's t&c's

I then asked SPECIFICALLY whether that could be used in ANY way to prove that I had accepted the goods at the price on the bit of paper he gave me and he assured me that no, definitely not, he was just a driver and had absolutely nothing to do with payment.
    This was further confirmed by the manager at CS who dealt with my refund, I told her I was terrified that he had been mistaken and that I could have inadvertantly signed an agreement to the price and she said certainly not.

    In addition, several people on here have reported drivers turning up with no paperwork, but they still took a signature for delivery. Those people could have been signing thousands of pounds away if that was the case :eek:
    As I said, I hadnt got delivery I was just going on what other people have said, many people said the driver asked them to sign.....others said payment wasnt taken until delivery....hence me thinking they accepted on delivery....as you said delivery drivers wont really know what the signiture is used for...so would be better to ask someone who might know a bit more, although at least you made the effort to ask :)
    It clearly says the GUIDE price could be different to the price you pay so at some point Tesco need to inform you of the correct price BEFORE the contract can be formed (if used a DC) so regardless of what the driver/CS say that is the only place I can think of where the buyer authorises that set amount.....as I keep saying the buyer can always return the goods after delivery...perhaps this is what they meant?

    As said above....if 'buyer' used a credit card this is fine.....if buyer used a debit card then this is illegal....hence thinking the formation takes place at the door (making the T&C's incorrect)

    I've just been looking at the sites general T&C which it says applies to its online stores and saw this reagarding payment

    In order to help us validate your payment card, a pre-authorisation amount of £2 is reserved from your account automatically when you check out. Upon validation of this amount, checkout can continue. On the day of delivery, full authorisation takes place whereby the total amount is requested from your bank and the £2 pre-authorisation request removed.

    It also says this

    All goods must be signed for on delivery by an adult aged 18 years or over. Tesco follows a "Think 25" policy, so if the person receiving the goods looks under 25, proof of age will be requested. If proof is not available and there is no-one of that age at the address when delivery is being made, the goods may be retained by the driver. If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, the driver will leave notification of attempted delivery and you will need to contact our Customer Service Centre to re-arrange delivery (see below for contact details).

    So this means that the order doesn't have to be signed for by the person who ordered (or the person who's name is on the card) so does this mean that signing on delivery can not be acceptence of contract for the price on the receipt?

    replying to an earlier poster... the money came out of my account on the 3rd and i was also refunded on the 3rd...so don't give up,think i was lucky and got in early before the phones went mad for refunds....

    I mean it.
    So far they have under refunded me by £17 odd pounds. I will no doubt be on the phone all day tomorrow trying to sort it out.
    Luckly i have spoken to very poilet people every time i have phoned. Shame Tesco are up Labour's bum and get away with so much!

    Firstly just to say I wasn't picking on you hon, I didn't put enough smileys in that post, was just pointing out all Tesco's conflicting info :p

    I agree that it shouldn't be legal to take that much extra without informing people and I have a theory on this suddenly....

    At the beginning of this offer, I believe when people filled their baskets, the guide price correctly stated the amount they would be paying including the offers, i.e. someone who ordered 12 products had a guide price on their basket of £9. Note that initially (Tuesday deliveries, so Monday's orders) almost everyone was refunded the difference without too much fuss.

    Now on Tuesday, when I ordered, the guide price was showing as the full amount, so for me was well over the £100 mark but it clearly said underneath that amount that special offers hadn't been included in that price and not to worry because the offers valid on the day of delivery would be deducted. (and the offer clearly stated it was on until 07/03/10

    I reckon that they must have changed something on that web site so that they were then covering their own backs as obviously they KNEW that they would be charging full price to the cards... what do you reckon?

    Note: I just got 2 phone calls in the middle of typing that so sorry if it doesn't make sense!

    This is because tesco have different versions of the website for dif accounts.
    I have a couple of accounts and one is the old version that shows the full amount with the 'discount applied after' statement (same as what you got). The other is the new version that shows discounted price in the total (same as some others).
    I don't know why this happens but it seems compleatly random as it has happend to family members. Some get the new one and some the old. Another way to tell which is which is that when you add vouchers the old one takes you to a seperate page to type them in. The new one however you type it in on the same page as the payment details.
