can i ask a quick question about r.o.s.o would halifax be able to touch my daughters account (which is with halifax) if the account is in her name but my name is tee mrs xxxx now that i have cca them

If you are linked to your daughters account, either by name or guardian then yes, quite possibly they could do. If it is your daughters account and you're nothing to do with it, then no, they cannot touch it.

I have read this thread with great interest.

Tonight i have contacted CCCS regarding my debt and i am wondering if i should pursue the CCA unenforcment process as i have a card from 2003 with 13.5 k on it. However as i contacted CCCS and haven't had my interview yet am i acknowledging the debt???

Some advice would be great appreciated. I have downloaded letter one and got it ready to post tomorrow with my £1 fee.

    Thanks

    Hiya yes send it off.

Its not so much about acknowledging the debt, but CCCS will not entertain unenforceability so best to test the water with this first and cancel your meeting for the time being. Once you hear back from the lender let me know.

If unenforceable - simples, you walk away. If not then you contact CCCS....

When did you last pay? You know you'll end up with a default, right?

they will only utilise roso in the event of overdue payments, so luckily one missed payment won't trigger much.... just sort it tomorrow, take ID and close the account - then just open a new one, elsewhere....

    It'll be fine :D

    Hi Mate

Hope all is well with you. Update as I've been away for a while -

Barclaycard - Still nothing at all from them, CCA sent 7th Jan, they havnt cashed my cheque, but i have proof of posting. Sent several reminders & cease and go away letter. But nothing at all not even an aknowledgement.

Halifax - After receiving a letter saying that they cant find the agreement and wont enforce, low and behold a copy of the application I signed in August 94 turns up (old Leeds Building Society CC) it looks pretty good but would like you cast your expert eye over it. There are no T&C that were in place at the time only the ones which are current. Having probs with photo bucket so if you pm me your email addy will send over asap.

MBNA - After that stonking letter you kindly did, all I have had back from them is a sorry for the delay we are dealing with it but may take time as this account was bought from another lender.

Mint - We have spoken about via pm

Monument - Had the original reply card I signed in 03 - will email over for your perusal.

Citi - Cease and desist letter sent 26th March - Letter received 12th April asking for 8 weeks to gather info.

Your valued and expert thoughts would be most appreciated. In other words thanks a million mate.

Hi NID - Hope you are well. Another quick one please.
Natwest sent me an illegible CCA which was an application form & t&C, I responded with the illegible letter, & then the cease & desist letter in Feb 2010. They then sold the ac to Allied International Credit who I sent the "ac sold to dca harassment letter". They have now responded saying Natwest disagree the ac is in dispute as they sent out the documents previously. Not sure what to respond with now please. With many thanks :D
