you should have a calculator topping up how much you have now deem unenforceable each month :)

LOL, it'd be bigger than the PAD thread totals i'd think - easily into the £100k a month bracket i'd say

Quite shocking if you ask me :whistle::whistle:

    Hiya

Ok so you're saying that the 6 lenders all sold the debts to Max Recovery? If so you need each account number and then you send 1 CCA Request and £1 cheque to each account, in 6 different envelopes - even if they are all for the same company - you need 6 x proof of delivery.

You have to be 100% certain that Max Recovery own all 6 debts, you have to find this out.

Forget PayPlan, they are no longer anything to do with this...... i'd be suggesting you check your credit files, i.e. Experian & Equifax - just to be sure nothing is showing.... :D

    Make sense?

yes, makes perfect sense now thank you!

just to make sure, the requests go to Max Recovery and not Fairfax?

and would the best way of finding the account numbers be by writing to Fairfax or Max recovery

I've checked my Equifax credit report and none of the debts that were in the IVA are on there anymore

there is a note saying the IVA finished in 2008 but that's it

once again, thanks for your help, really is appreciated

also seems that Fairfax have now got my mobile number (probably cos I called them off it!)

received a computerised call from 0843 377 0041 that didn't state who the company was just said press 1 if I am who I am! Hung up

What was your last sentence again? :rotfl: You send to whoever owns the debt, so Max. :D

Send the CCA Request and use the company name (i.e. Barclaycard) if that makes it easier, you MUST remember who you owed money to, at least the company names?

And Experian? You know not all lenders report to the same CRA? So you need both Experian & Equifax.....

That entry will be removed after 6 years.....

Ooops, you'll learn never ring them - ever! lol..... just get used to ignoring it, when you've sorted the CCA Requests and got relevant details we can look to send a harassment letter and stop the calls, but cannot do it until the debt is in dispute... :D

sorry, still being a bit thick!

none of the debts from the IVA are on my Experian file either and there is no mention of the IVA on that either

I have the letters of assignment so know the company names, so I'll sent the CCAs tomorrow when I finish work!

    Cheers!

    Hi NID,

Hiya - send this: CCA Query

It is 100% unenforceable :T, you should report back when you get a reply (then you send final response)

    Thanks Niddy

I bet you can see why the letter made my laugh, their statement about it's enforcable and they wont talk any more about it!!!!

I thought that the powers that be, had stated they should not misrepresent the enforcability of an agreement, but since when do any of the bank take any notice of anything!!!!
  • :jThankyou for replying to my ask for help, I know you are very busy. Its just brilliant to have help like this when you are faced with a tough time (and divorce) , so nice to see there are knights in shining armour. I will send the reply as suggested and let you know how I get on.
