    They never said that - they said they have terminated it (with a default notice) and they want paying! They will always dispute the unenforceability aspect, that does not concern you. Just send the template as directed and they will go away. :D

    Also something else I was going to ask you NID, around the time the judge looked at the last lot of CCA's a few months back, there was a rumour that one bank had dumped every CCA they had...:rotfl:...any idea which one that was rumoured to be?

    Yes they do - especially if you completed the 60 second application form, that was the norm a few years back - totally non compliant :rotfl:

    Yea, the bank was MBNA - they didn't "dump" them all though, they dropped two at the last minute and also 100's others were put to the "back-burner" so to speak ;) Don't look too much into that though.... :p

    Hi nid have come back over here from mouseanns thread so what do we do now how do i get a soa to you and could i do this first thing tommorow as my head is battered with a heavy day. You mentioned leaving the phone calls at work to be kept seperate again what do I do? Thank you so much for taking me under your wing

  • hello i have £32k of unsecured debt from some holidays and paying for my bmw. the bank is demanding too much money from me i am just a part time cleaner on £5k a year, this is not fair how can i write off this debt

    Hi Jinny

    No SOA needed here, they are only any use if you're planning on making repayments - in which case i'nm the wrong person :p

    Basically, can you start by giving me some info, simple things like how much do you owe, have you got defaults already, what is your problem exactly - i.e. are you looking to get it made unenforceable or did you want to negotiate repayments?

    Obviously the more info you can provide me about your debt background, the better the advice will be......

    Thanks Jinny - just need a list of creditors, amount owing, last payment made, are you in arrears, have they defaulted you etc etc?

    Generally, imagine that I need to be standing in your shoes - so tell me as much as you can without giving away your identity of course. :D:D

    I'll be here most the day so whenever you're done stay online so I can check and when we've got everything listed i'll work through it all for you.... :p

  • I am an old hand on the reclaims stuff but I have a question or you(and I hate saying this) but I am sure it is in the thread here.
    1) If the CCA is unenforceable pre April 2006 can you ask a court to give a declaration that it is unenforceable and therefore forever unpayable(so to speak)?
    2) What does the recent CCA cases ie Casey v. HSBC make to the way Unenforceable agreements are advised by yourself on here?

    Apologies for asking potentially tough questions early on a Saturday but am trying to get my head around this and sometimes on the Reclaims board I refer them to yourself cos it is still difficult to get out of the approach unenforceable is not unpayable in spite of the First National Case in which the judge did say more or less that any agreement that was unenforceable could be construed as a gift.
    I hope the above makes sense.
