    Quite right, I apologise.

Educate me. Why, other than to "debt dodge" (expressive only, no insinuation intended), would someone want to look at the enforceability of a credit agreement?

Anyway how do you expect anyone to dodge a debt that has a bona fide agreement?:think::think:

When “Customer's” hit a difficult financial period, they ask there financial institution to be understanding / supportive / considerate, whilst the they're experiencing difficulties.

Sadly, the financial institution doesn't give a dam what stress the customer is under during their difficult period, in fact they add to the customer's stress levels by trying to to intimidate them with threats of legal action, phone calls, etc., etc.,

Consumers in financial difficulties ask for a level playing field that's all, however, when a financial institution wants to play “dirty” every consumer has a “legal” right to pursue any "legal" options open to them.

See, not really “debt dodging” is it?

Very well said. And a quick bump for niddy's thread........:D

I Just said "I've asked in my first letter that I want everything kept in writing and I'd appreciate it if you don't ring me again. Goodbye" before putting the phone down.

    NID,

I'm starting this process with a DCA who is currently in control of an old Barclaycard account. They are currently threatening legal action so I would like to send the the CCA request ASAP, however I am out of the country for 4 weeks from the 20th April, should I wait until I return or just send it now?

    Cheers,

    Ash

    Hiya

Send it now so they get it, this gives you 28 days (dispute) anyway so suits the dates you're away.... send it before you go then let me know what they respond with.

Remember to add a £1 cheque/PO and send it recorded. :D

What's the June court case regarding? :(

See here - Egg Card - CCA Flawed?

It is Egg, as they use the wording "approved limit" which is non compliant with the CCA - it should say "Credit Limit" :D

I wonder if Jammin is connected with some of those disgraceful DCA's duping many into paying back monies they aren't legally entitled to collect if no copy of a compliant CRA has been supplied? Not really debt dodging at all! I support Level playing fields.

No, he is not. He just asks a lot of questions, sometimes crosses the line - but hey, i'd not accuse him of that (yet)... not enough evidence ;)

Well done - you should have done it a while ago lol.... but I appreciate you were away (skiving tsk)

You know, why not try and blag it and send off the CCA Dispute letter, see what they come back with mate. If they threaten court then you can agree to repayment, but why not see if you can make them doubt themselves... I done this recently with someone on here, they had an enforceable agreement but I told them it was unenforceable (sorry) - however I knew they would not try and blag it, thus I had to lie! Sooo, as it happens the DCA wrote back confirming no action will be taken... nice result, another £12k [STRIKE]written off[/STRIKE] deemed unenforceable :)

    * Note - I don't often give incorrect advice but I had to on that occasion as the OP would have paid it back, and I thought the gamble would be worth taking... ;)

Ooooh Locke, you mean mean person you.... (are you m/f by the way) :D

If I call any females "mate" - I apologise up front, as I use that term all the time, but not to females - thus I assume you are, with your username and/or tone of post! .... ;)
