Sons benefits help

Hello i have a 14 year old son who has Aspergers and im on income support and also get disability for him.
However due to his age and needing some space he will now go and live up the road with his nan monday to friday nights and come home friday night til monday morning.
Thing is shes 60 and has been made redundant and now receives job seekers allowance and housing benefit.She rang the housing and told them my son is there part time and can she receive more rent because of it.
They told her I have to sign something over (i dunno what benefit) to enable this to happen.
Thing is hes only there part time and I still support him financially,will i lose all my income support/child allowance ?/

    You will lose all child related benefits are his nan would be classed as the main carer not you.

  • So i would loss income support,single parent allowance disability and carers allowance(even though hes here over 35 hours a week) and child benefit?

    2 people can't be classed as carers for the same person. Either you or your mother can claim but not both.

    In order for his nan to claim she needs to be recieving the child benefit. So as you won't be getting that you can't claim the tax credits or income support. Also your LHA rate may decrease due to you not recieving these benefits

    Although he is with you over 35 hours he will be with his nan far more than that so she would be classed as the main carer and be able to receive the benefits for him.

    I guess it is similar to a child going to stay with their father for weekends, the mother would still get all the child related benefits, the father would not qualify for any even though he has the child for that length of time...plus he would be expected to pay child support to the mother for the 5 nights the child stays with her
    (note father could be replaced with mother and vice versa but you get the gist)
  • Ok thanks for your help,well maybe if he stays here mon to friday (which is much easier for us all) and his nan weekends.Would she still be entitled to more rent thats way (she currently gets single person rate and has to pay 20 a week out of her 65 allowance) thanks x

  • Hi DeeDee,please contact benefits people ask for the forms for claiming for "time spent at home",you should still get some help :beer: I did my son went to special school I got help for time spent at home other benefits were not effected :)

    The nan still won't get anything else if your son stays at weekends, ESP help towards rent as she isn't getting any benefits for him.

    sorry but i don 't understand why you are doing this, it seems to be so your mum can get extra money for her rent??

    Will she not be going back to work? And if she did wouldn't that mean you have to change all the arrangements again?
