    Ok, i accept your wager but instead of posting links, i'll point you to a parking company who has already published their wins. You'll find links, newspaper reports and court summaries here: combinedparkingsolutions.com/legal.html (as a new user i am not allowed to publish links)

    Lets make it easy! say the last three years we have had 10 posters a day being advised to ignore! [usually many more but for the sake of the bet] between here CAG and Pepipoo just to name 3!

    3 X 365 X 10 = 10,950 :D you need to come up with at least 109.5 defended wins!! remember undefended dont count!:D Oh and to be fair they have to be satisfied as well, seeing you thought your friends didn't need to satisfy theirs!

    A private parking company is contracted to private land. That company has an awful lot of legal work to sort out before operating, including scrutiny from councils, health and safety, fair trading, BPA, SIA, bye-laws, laws etc etc. They then act within those guidelines to control parking. They act within the law.
    Now perhaps you can tell me by what laws you act in encouraging trespass?

    I didn't say that was the best i could do, but i did indicate that was all i was prepared to do at the moment.     Judgements handed down by courts are public documents (including CCJ's) , as such there is no reason to not publish them.

    There are no regulars here who advocate or encourage trespass.

    An individuals conduct is a matter for them , it is the wholly disproportionate response of the PPC industry that we object to.

    Looking at the few cases that PPCs do pursue into court the vast majority are for "breach of contract" not trespass.

    The LAW provides that the legal remedy for trespass or breach of contract is reasonable losses and/or damages.

    This is why PPCs lose in court because the amounts they claim in no way reflect losses or damages.

    Trepass is a civil tort so it is not "against the law" i.e. a criminal offence.
    To this end it may be morally wrong but it is not a crime.

    It's a bit like PPCs and debt collectors sending letters to registered keepers implying that all manner of dire consequences will result from non-payment when they know that the keeper is not liable !

    Or maybe like one of the larger DCAs used by several PPCs quoting civil procedures rule 31 even though they must know it is not applicable.

    Hmm on second thoughts actually what the industry does probably is criminal ..i.e. attempting to gain pecuniary advantage by deception.

    And on a final note how would you justify APCOA trying to charge anyone £80 for their passenger alighting whilst the vehicle is stopped at a red light ??
    (One would think APCOA as one of the largest parking companies would be setting the standard for others )

    I would love to hear your legal and moral points on that one !!!
