    Great to see that it will all be going on regardless - its made interesting reading over the past I dont know how long - cant believe how the landlady is being, surely courts papers would have made her sit up and listen but she is obviously one of the sorts that will try and dodge anything and thinks they are invinsible!

    Bet you are sort of relieved in a way after speaking to that person on the phone today.

    Great news!! Default judgement should be a walk in the park - they're a very one sided hearing as you can imagine! Landlady must be pretty stupid to think she can just ignore the court. Once she get's the judgement through that should make her sit up and listen! LOL! She might then apply to get the default judgement set aside - she only has a limited time in which to do this - failing that it will be on to enforcement. My guess is that she'll pay up once she realises the case is proceeding to trial.

    This makes me think that there should be lists of rogue landlords pinned up on the walls of letting agencies. I'm thinking like the kind they have for people barred from pubs - except with mugshot photos for added humiliation :-)
  • Def feels better now - we don't have to do anything, the court is now earning its' £80 and we sit and wait.

    Yes the letting agencies should have such a list, but they never will as they can't reject business... plus, we know that her aim is to ditch the letting agents alltogether, as she wants to keep all the money to herself. We know what she's like though - she doesn't want to pay someone to manage the property but she's also not wanting to manage it either, I pity the fools who rent property from her. The girl in our old flat is single and pregnant, up 3 flights of stairs and has storage heating for this winter, plus no double glazing and a busy road outside - not nice, especially when we used to pay £540 to the letting agent, and by all accounts this girl is paying over £650 now direct to the landlady. All thanks to a lick of paint and new carpet - the LL must be happy as a pig in sh*t with that one!

    Due to a great offer on the Vouchers board recently, I have 18 bottles of wine arriving tonight, at £2.50 each, so that will help! Plus I'm off to see The Departed tonight with friends - all this will be at the back of my mind, for now...

    re rent increase, why not put a note thru the door of your old flat, telling the tenant that she can go to the Local Rent Office to have her rent assessed - this increase, i am certain, would not be acceptable to the LRO.

    When I say 'crate' I mean boxes - I got 3 x boxes of 6 bottles = 18.... for £45 and Tesco delivered at 18:10pm - the slot was 18:00-20:00 - so I was pleased. Haven't opened any yet, saving for next week, 1 bottle per week as that's the max we usually get anyway.

    I'm hoping the court won't take too much longer as the LL is moving soon - can't help but wonder if it's also a ruse - ie - she plants the info with the newsagent so we hear about it, get nervous, and we get back to the letting agent wanting to negotiate?

    At any rate, a CCJ against her name will satisfy us no end at this point, even if we don't get the cash - regardless of where she lives.

    I called Lewes Electoral Register yesterday and they are posting me a sheet that says she's registered at her address to vote, which I was going to take up to the court to add to their file. Should I also take the letter from the letting agent offering to negotiate and let them copy that too? I took it up on Tuesday but just to show the clerk at reception.

    Yep do that - proving you've done all you can :) I had a problem like this once and whilst it was stressful at first once you start winning and start playign the game - satanic-landlord-baiting is great sport, it can actually be fun :)

    The LA will tell the judge that they offered to negotiate on behalf of the LL (if they deny being liable for the debt). However, since LL coresponded directly with with you, what use is the LA? After all, the LA didn't help with you finding out where the LL lived. They've hardly been impartial.

    I would add the letter of proof of her address to the file. The judge will know that you've made efforts to trace her and that her 'Gone Away' reply is indicitive of her atttitude in returning your deposit.

    It's not looking good for the LL is it ;)
  • Sounds like you've got over this hurdle but just in case: if you are a member of a trade union, you may be entitled to some free legal advice. I recently found out that my union offered me half an hour free.

    Anyway, enjoy the wine!
