    Hope it all gets sorted for you as it seems to have been going on for ages!

    If she doesnt respond does that mean that it will automatically go in your favour or that the judge will look over it and decide which way it is to go (will be in your favour hopefully!) without anyone having to go to court?

  • I've just picked up on your thread and spent all my lunch time reading it today and I couldn't believe when I got to the end of page 19 that it was still going on! Have sat with baited breath all afternoon wondering what happened - What a saga!

    I think I might need a glass of vino when I get home to recover! ;)

    I think the judge reviews it and decides - but the form says this:

    'The defendant has not filed an admission or defence to my claim or an application to contest the court's jurisdiction. Decide how and when you want the defendant to pay. The court will send the defendant an order to pay. You will also be sent a copy.'

    I presume the 'how you want them to pay' bit is only if there has been a jurisdiction made, which has not happened yet.

    However, I do get to tick the box saying she's not filed an admission - they said that then they take it from there and we will be notified in due course of what is happening.

    Letting agent haven't said anything else...

    I'm going to take the paperwork to court around lunch time so will update you when that box is ticked (with a Big Badass tick, Clutton! :D )

    Well, I have just gone up and done the deed - they said it should be processed in a week or so and she will get a letter informing her of what is happening, so will we.

    Clutton - I didn't go to the newspaper (the local paper is the Argus) as I felt that would be something to do if the court aspect didn't pan out - I don't know, do you think it's worth doing?

  • You will just have to invent another way for everyone to stay in touch. We have all become friends over the last couple of months and i for one will not know what to do with my time if I am not checking this thread for updates.
