WHEN the court awards in your favour, if she pays up the full amount of the debt within (i think it is 7 days, cojuld be 10) she will not get a CCJ awarded against her. When she realises this, it may focus her mind to pay up quicker rather than later = unless she is Monumentally Stupid.
DON'T write her a letter !!!!!!
listen to the good MSE folks who are willing you to teach this woman a lesson !!!
you have the upper hand right now, sit tight! stay cool, have a G&T, play computer games, make love - whatever !!!!! !!0 -
Hooray for EagerLearner! I've been following this thread for about a month (and it was already 10 pages long then!), I have all my fingers crossed that you get all your money back, every penny.
And if my landlord dares try any of this funny business when i move out, this thread will be invaluable, there's some fantastic advice on it.
I've been shafted by a landlord before, but rather than go through all the hassle of trying to get it back, i just let the money go. Wish I had your persistence, the more people that stand up to greedy landlords, the better.0 -
i went to a landlords professional forum yesterday and as far as Gas and Electricity regs go, both landlord AND letting agent are jointly responsible for compliance - don't know about the rest of the lettings duties.0

Thanks guys - good suggestions from you Clutton - hmmm, wonder which way i will choose to relax? So many options!
In terms of gas and elec - I think the only problem was that there was a fault with the elec meter - we arranged for Seeboard to fix it but whatever they did, it did not fix it. I pity the girl who now lives there - pregnant and living on her own. No doubt, when she gets a huge bill and calls landlady from hell, we will be the ones she blames!
Thanks for sticking with me everyone - we are full of resolve now and eagerly await news in the next couple of weeks.MFW #185

Just had to say that I've been following this thread for about a month too, and I really want to see this thing resolved in your favour. Please, please, please do keep us updated!Anything I post here is purely my own personal opinion. As such it may be wrong, poorly worded or written very tongue-in-cheek. Please therefore treat it the same way you should treat anything you read on the internet from an unknown person - with a healthy pinch of salt and scepticism!0

good luck egerlearner......just read thread start to finish....cant understand why you couidn.t get her address using data protection clause for court preecdings all that time ago,,however you got her address in the end and hope you win big

Thanks Karljay - seems there is one clause under the Data Protection Act allowing you to get the data for court action, and another allowing them to NOT give you the data, under the Data Protection Act!MFW #185

Hi eagerlearner,
Any news yet on what is happening? When did the landlady have to reply by?Weight Loss - 102lb0 -
Hiya - it was last Thursday 14th and still nothing yet from the courts.
We didn't answer the letting agent letter, don't know if they are now telling the court that they're delaying things as they're waiting for us to respond...
I'm sure something should happen this week?
Hope everyone is having a good Tuesday anyway... I had a shocker earlier when I updated my version of the spreadsheet below and found out how many hundreds of pounds I've withdrawn from ATM's and have no clue what I spent it on! Spending diary here I come.MFW #185

I would give the court a ring to ask what happens next, you don't want this to drag on any longer than necessary. If the LLady hasn't responded you can find out from them what you need to do next.
Good luck0
