    Thanks guys - we will be taking all docs that show info re the address from Lewes Electoral register (both the letter from October and the letter from 11th Jan 07 which we got yesterday).

    I will copy her 'setting aside' judgement court letter and staple a copy of Glorias invoice attached to it to show the c/o address is the same.

    Presume we need to take the e-mails we sent to letting agent asking for her address?

    Do we need to take the inventory, to go against her claim that we 'owed more than the deposit'? Plus a copy of all the costs.

    Anything else? Would love your input as so what docs we should take so we don't forget anything...

    Better take everything just in case the judge asks for it. Although, he should already have it in the "case bundle" at the county court.
    If he throws out her action to "set aside the previous judgement", you won't need it, but better to be safe.

    Hiya P - he won't have any 'bundle' this time as we haven't sent anything yet. It was in the last case against LA that we had a bundle sent to judge and other party, not this time round as the court said we could take copies with us on the day.

    INTERESTING GOSS:

    I went to collect mail from the newsagents the other day (on the ground floor of the flat where we used to live) and apparently the landlady has called them and asked them to pay 3 MONTHS rent upfront as she claims 'cash problems'.

    What if she tries to claim cash problems in court - could she theoretically end up paying us tuppence a month from here to eternity???

    Maybe the Inland Revenue have asked her to pay her back tax :D

    Bit hard to claim poverty if she has assets (several rental properties/her own home etc) and incomes (rent)...

    I'm sure the LL would have been most sympathetic if the newsagent had called and asked for a postponement of rent for 3 months due to cashflow problems .....

    Surely they wont have to pay 3 months rent upfront if it doesnt say so in their contract?

    It looks like reality has hit the witch. About time too. What a cheek, asking the newsagent to pay 3 months up front - I hope he told her where to go.
  • Yeah he (newsagent) wasn't best pleased and thought it was a bit of a joke that she's asking them for cash when she owns the whole building and other properties too.

    It did cross my mind that the IR may have looked into her... :D :cool: ;) - what a thing to happen to someone! And at this time of year too!? Gosh.

    The word 'Karma' brushes lightly past the edge of my conscience, but hasn't come into view because there's no firm knowledge, only keen assumptions...!

    We have a little pile ready to photocopy tomorrow, includes:

    - The inventory
    - The renewal agreement from early 2006 with her address
    - The invoices presented by landlord
    - The 3 warning letters we sent in August, inc the returned envelopes from Royal Mail
    - the letter from 11th September stating a wish to negotiate
    - The letter from the court saying she returned the letter regarding court case
    - The letter from court re judgement for claimant from October
    - The fax from letting agent with her 'new address' from November
    - The letters from Lewes Electoral roll showing she does live at the 'real' address
    - The printout showing the Tenant Act 1987 (section 48) requiring a servable address for the landlord

    Is this too much? I am planning to make 2 copies of all tomorrow.
