If the bill was entirely incorrect and the guy doesn't even work for them then they will find it tricky to prove that they even visited to do work, let alone a correct diagnosis!0 -

20 odd years ago I had a central heating system installed into a house we just moved into. The guy who installed it was a friend and travelled down especially to do the job. Had a problem with it a couple of years after installation and called out a local guy who appeared, spent 5 minutes in the house and declared that he couldnt work on it as it was an unsafe installation. He said that the outlet for the boiler was dangerously sited and against regulations. As you can imagine I got on the phone to my friend and started laying down the law. Turns out my friend installed correctly but the guy I called out had always disagreed with the regulations regarding siting outlets.
Fair enough - everybody entitled to their opinion and perhaps this guy is right and the regulations could do with updating for safety.
Cheeky monkey then sent me a bill for call out. I told him it was his own decision not to work on the installation and that he had no grounds for refusing to do so therefore had no grounds for charging a call out fee. Then received a letter from his solicitor threatening legal action to recover the amount (was about 40 quid then grew with late payment/legal fees etc.). I took the decision to contact the solicitor involved to make sure they understood the reasons behind the charges and their non payment (I did not want to incur my own solicitors fees which would probably have been non recoverable) and advised the solicitor to ask his client directly why there was a dispute. He (I assume) did then wrote to me to inform me that there would be no further action. Hopefully, he told his client he was a right eejit and to get a life.
Dont know whether it would go that sensibly now but I was quite chuffed with meself .....
