old landlord wont give us our post what do we do

    First off all you know is that on two occasions the landlord has stated you have no post. You suspect he is lying but have no evidence.

    Therefore you need to find out if correspondence has been posted/delivered to that address since you left. Find out from those you are expecting post from. Start with the 3 things you were expecting to be delivered.

    When were they sent.Which carrier was used. Is tracking available. Did they need to be signed for etc.

    By making these enquiries you will be better able to determine whether your suspicions re the landlord are correct or not.

    In the meantime keep badgering the agents on a daily basis.

    In respect of the offences discussed the Post Office acts are intended to deal with items in transit. More suitable legislation exists for items not in transit.

    E.g. If I am walking to the P.O. with a sae containing cash in my hand and it is snatched then it would be a matter for the police and be dealt with as a theft of cash and not theft of mail.

    If I make it to the P.O. and they take it for delivery and it is stolen or the envelope is opened and the cash taken whilst in their possession then although a theft the police would probably pass this to the P.O. investigation branch to deal with. The post office investigators would be more likely to use postal legislation.

    The envelope and cash survive the footpads and dishonest people within the postal service and makes it through the letterbox of the address I sent it to. Unfortunately someone other than the addressee opens it and decides to keep the envelope and contents for themselves.

    This is not theft of mail but theft of property and is a matter for the police not the Post Office, to investigate.

    So in the OP's case if the landlord is doing anything other than returning the mail to sender or retaining it for the purposes of handing it to the OP then the landlord is committing theft.

    Seeing it from the other side, it's really annoying (living in flats) to keep having ex tenants from other flats, lots of which don't redirect their mail due to debts, keep buzzing my flat and others, to be let in to collect mail they haven't had redirected.

    I have let them some in on a few occasions but some were nightmares I don't want accessing the block anymore, after all they have no right to access. I put 'RTS/no longer at address' on as much post as possible now so they are wasting time coming here.

    Not saying the OP falls into the above, but it can be annoying if people either don't redirect or do it in time/contact companies directly.

    You shouldn't let anyone you don't know in as it's a breach of security. We had vagrants living in our building for three weeks a few winters ago, apparently they got in through leaving the fire escape door ajar and simply buzzing to be let in! :eek:

    That's shocking they would do that!! Lots of people let people in in flats without checking who they are.

    But agree, it's best not to, I've only let the nicer ones in on occasion who I had known.. but even they annoyed me that they didn't do a redirect! I had to threaten to call the police to one horrible, aggressive couple though, they were antisocial neighbours when living here so I wasn't going to do them any favours after they moved out..
