old landlord wont give us our post what do we do

  • You have no legal right to the mail, it has been delivered to the correct address, so long as the Landlord does not open it he has committed no offence.

    Actually, that's not correct either. It is not an offense to open someone else's mail if it has been delivered to the correct address, regardless of who the named individual is. It is however an offense to put that mail to fraudulent use. See the difference?

    Send them a recorded delivery letter, requesting your post and letting them know it is a criminal offence to hold on to it, if you still do not receive any post from them you can go to your local police station and report them, same thing happened to my daughter, for any further info the citizens advice bureau is very helpful.

    She has redirected, but it doesn't come into effect until 12/02

    Forget about junk etc, call important people (banks etc) and let them know personally about the change.
    For the people sending specific items/letters. Ask them to tell you the delivery status and if recorded, see if it's been signed for. He would be breaking the law at this point if he refused to give it to you... that's like saying that if someone accidentally wrote my number instead of the one next door, I'm entitled to keep whatever I signed for!
    If he still claims to have no knowledge, then contact these people again and get them to show proof of postage and claim for the amounts of the items which were never delivered.

    Whoever takes any letter, postal card, or package out of any post office or any authorized depository for mail matter, or from any letter or mail carrier, or which has been in any post office or authorized depository, or in the custody of any letter or mail carrier, before it has been delivered to the person to whom it was directed, with design to obstruct the correspondence, or to pry into the business or secrets of another, or opens, secretes, embezzles, or destroys the same, shall be fined under this title or imprisoned not more than five years, or both.

    He should not be opening it, keeping it or destroying it. Therefore yes it is a criminal offense!!!
    He has no legal obligation to send it on himself, but if requested, he has to return it.

    Unless things have changed, you can do it for 12months max AT A TIME.. you can renew it up to a maximum of 2 years in total or something like that..

    Maybe he is just putting it all back in the post box.

    If i had tenants that just left, i wouldn't help them out. I would mark all 'Return To Sender' and forget about it.

    Sorry, but you are completely mistaken. The quote you included in your post I believe relates purely to Royal Mail employees. I reiterate: it is not an offense to retain, open or destroy mail delivered to the correct address, the only potential criminal offense is putting that mail to fraudulent use.

    Now we have established the legal position on delivery of mail...

    The OP should become a real nuisance to the letting agent. In my experience as a consumer and employee, it is the nasty persistent ones who always get their way. Phone, call in the office, threaten dire legal consequences etc. For a peaceful life they will pressure the landlord rather than accept his lies.
    Been away for a while.
