    Phew - what a call - I have been advised by Orange that the equivalent handset is the C1 or C2 - I have said this is not acceptable - its not equivalent in any shape or form. I can come out of the contract and swap onto another contract and to get the Desire it would cost me £30 a month. The only other alternative is to escalate this up the chain - the next person in the link is away until next week. I apparently will be contacted sometime within 14 days. When I said I wanted a callback before then I was told it would be within the 14 days!

    C1 or C2 is a joke, no comparison at all.
    You want a 3.5" touch screen with somewhere near a 12 mega pixel camera. The Nokia N8 would be a good comparison.

    Had a look at the 36 month T&C's and you want "one equivalent to that which was available at the point of connection".

    Up to you where you want to take it, but they would be in breach of contract giving anything of a much, much lesser spec.
    They can't 18 months in state it was an error.

    Hi Folks - I have just recieved my HTC Desire S as an upgrade.

    This was not so easy to get but with a little persistance was acheived.

    I rang the other day to be told that my upgrade not due for another 6 months, however I looked on the terms (which have changed twice since) read them out and the guy agreed. Then he offered me a c1 or c2, at this point i had the manager on the phone he said my upgrade due next day ring back and he will put notes on account that i will get as per t&c

    Rang back, guess what? No notes, guy just parrot at me £5 contract blah blah blah. Anyhow i then had mangeress on phone, she went on that a proper contract may not been drawn as i got contract from web and that i had not activated account till few months later (unlocked n debranded phone) anyway she said i was right, i said get on with it then, what u arguing about?

    Asked what i wanted said iphone or samsung she said they were £700 i said the samsung £450 i bought one the other day, anyhow got htc desire s

    good lucky xx

    p.s the very least u should be coming away with is a cancellation of the policy for breaking th t&c's

    Well done sinw and a lesson to be learnt.

    The T&C's are in your favour and don't settle for a C1 or C2 - get an "equivalent" handset.

    As above posters show, a Desire S is easily achievable, well achievable, and so should the Nokia N8 be (12 megapixel camera phone). ;)

    If they argue, just state the "Supply of Goods and Services Act 1982" - they should get the message you know your rights.

    Sorry havent been back on - been really hectic the last week or two but guess what .....

    I have a new Nokia N8 and its thanks to the support on here and a lovely lady that has been messaging me on here and encouraging me to stand firm and also it changed completely when I mentioned the Supply Act 1982 and the fact that I had the t and c's in my favour - so thank you all xxx

    Well done danemi1, shame you had to fight so hard.

    Beware: Check your contract hasn't been re-set at 36 months. It has happened and shouldn't have because 36 month contracts were banned in May this year. Maybe give you a get-out clause as it may be classed as mis-selling. Double check.

    I was lucky enough to get the Satio £5 a month contract last year, and I'm currently trying to sort out the promised upgrade.

    I'm a bit late in doing it because I've been away.

    I'm inspired by your successes, but everytime I ring I get laughed at and turned away at every step. I've quoted the terms and conditions and Sales Act 1982, to no avail.

    Does anyone have any advice they can offer on what exactly they said? Please!

    I also got the Satio through this deal and have also just remembered about the 18 month free upgrade. Where about were the Terms & Conditions? I can't seem to find the original letter that came with the phone. Is there any chance you could upload them to Flickr Kingd316, if thats ok? Cheers, Nick.

    Took this out. Time to cancel now. Phoned to ask if any upgrade girl tried say my last upgrade was the start of contract and I have another 18 months pay. Advised her this was wrong, after lot arguments she agreed and couldn't offer me anything only a more expensive contract. Advised her cancel, she advised will take last payment and credit me back. Oh no they won't, I cancelled ddm ASAP. Chance me xx. Was fun.... Goodbye orange..... :beer:
