    I rang the other day to enquire and was told c2 or if you wanted to upgrade to £10 a month for rest of contract he offered me another phone - cant swear to it but think it was a C3 - wasnt much difference I know that

    Okay here goes.

    I phoned up yesterday to upgrade, after a very very long wait I was finally put through to a supervisor - as anyone else I spoke to insisted "you could not have got a Satio on this plan".

    Supervisor said "Nokia C1 or C2"...after which I repeated the terms and conditions (which btw have changed since April 2011 but still mention equivalent handset upgrade) and insisted that he was breaking the terms and conditions of my contract. Held for a bit, he said it was a genuine error and that he would not repeat it by offering me an upgrade, but I stood my ground and said I did not pay £5 a month for 18 months to hear him change the terms of my contract.

    Tip here would be to persist, they will keep saying the same thing - so should you! It does not make your case any weaker (as some of us might think it does) to keep saying the same thing - you make them move before you do. He kept throwing to me "I will not be able to give you a handset" but I kept repeating that this would be in breach of contract.

    Anyhow the conversation continued, and he said I won't be able to offer you a £450 phone anyway because the Satio was only worth £300 when you took it out - at which point I could not help but to disagree and made it clear to him that that was not a correct value.

    He then said I will offer you the option to close the account - I refused (though was tempted), and then he mentioned after some arguing a HTC Desire S. I knew instantly that this was not the latest phone (as Satio sort of was when we all took it out) but I knew it was in the region of £300-£350. I pushed for more (cheeky) but he wouldnt budge (as expected). Then he mentioned that he will get in touch with the legal team to find out the implications of him not sticking to the terms and conditions - and which point I took the HTC Desire S.

    I would've loved to stayed on and awaited after he did that but took the Desire S - a thought came to mind that maybe we dont have much of a right if they dont abide by the t&c's and can only offer us a closure of a contract? So i 'dealt' and took the Desire S - a decent £350ish phone for the remaining 18 months (which works out at total cost of £90) for free.

    Tip: Don't give up! You have the terms and conditions with you.

    they are saying c1 and c2 are same standard as the satio - still holding

    oohey - nervous - well I have had the Manager on the line to say she understands but from a business point of view it does not make sense - she is going to speak to the legal deartment and will ring me back in the morning!!!!!!

    thanks for reminding me i got this when it first come out,only used it twice didnt like it,put it aside and fogot all about it think ill stick it on ebay now.ta again

    I just took what they offered, didn;t argue.
    Well done to anyone who manages to get a better phone, you have more nerve than me. I used to answer calls for a large credit card company and i was part of the team that dealt with escalated/angry calls, you'd think i'd have the courage to stand my ground.
