Accident Insurance forms

Hi, I need advise.
I was involved in a car accident. A guy smacked into my car as I turned. I had my family with me. My wife was hurt and ambulance called. Anyway my son who’s ten keeps complaining of back pains and just found out my wife has a slip disk (found out after 8 months, good old NHS waiting list).

I’m rubbish at filling in forms and have been avoiding the legal forms to try and get compensation. I’m worried I will mess them up. Is there anyone professional who can help me fill them in, someone who can advise to fill them in with me, like lawyer or someone? I had legal cover so need to fill forms in. help please.

    You should be going to a solicitor who does no win no fee. There are thousands but avoid the television one's. Do not go through your insurance company as they tend to do deals with other insurance companies.

    If it was deffo the other drivers fault and there is no dispute you should get a couple of grand for both injured parties as a minimum but don't come and bash my head in if you don't. You will not pay a bean but go through the right solicitor. There must be people around you to advise. If you PM me and tell me the town you live in, I may be able to help as one of my children works in that field. She is not in the solicitors but deals with them all the time and may be able to tell me of a good one in your area.

    Sorry but I can't understand if one of your kids is injured why you haven't had him to hospital?

    Forgot something. You must inform your insurance company of the accident but you do not have to claim through them. You just tell them that you are informing but do not wish to pursue the claim through them and there should be no problem.

    As stated in previous post, insurance companies tend to do deals between themselves, i.e. you scratch my back etc.

    Any decent solicitor will put you right on that.

    Could you please give more details of the accident.Especially the position of the 2 cars.For instance,if you were turning right at a junction and were hit by a car going ahead on the same road,then it may not have been the other drivers fault.

    On the assumption that the OP was not at fault, the family could side step the NHS and get treated privately so it is essential to get those forms back.

    I presume the forms are for your legal expenses insurer. Why not go through them one at a time and see just how much you can complete. Then, come back on here with any questions you have and see if we can help.

    We do need more details of the accident though because from what you have put I agree with suffolkb that you sound responsible for the accident. However, even if you are, your wife and child can sue your insurers for their injuries and the sooner you get this going the sooner they can get the treatment they need.

    Well I was stopped to turn right of the main road into a retail park. There was one traffic lane from the oncoming traffic and an AA school car stopped. As I turned another guy decided to overtake from the left side where there was no lane, the road was marked with the diagonal lines not for use. He hit the passenger rear most of the impact on the left side passenger door.

    I got legal cover and they have sent the forms.

    What you have put here seems to be just what you need to put on your accident form but adding at the end "The other vehicle started to overtake after I had started to turn and I was committed to the manoeuvre". This will be self evident anyway I would have thought from the position of impact as it indicates you were well across the junction before he came out.

    I had to get my OH to draw the road plan for my claim as I made a mess of it but it only needs to be basic.

    Your wife and son also need to start their own claims which they may have to do independently. I am not sure they will be covered under your legal expenses insurance so you need to check that. If they aren't, they will need to instruct someone. It would be worth speaking to your own solicitor about that as it may be better for them to use the same one.

    The solicitors that have been appointed under your legal expenses or your insurers will/ should be able to assist you.

    Legal expenses insurance will normally cover all passengers in your vehicle even if it you that they are suing for the accident.

    Surely that can't be right as you could end up with the legal expenses insurer paying legal fees to sue itself. The solicitors would also have a conflict of interest and they cannot act for the claimant and defendant.

    Yes thats right,

    I'm currently being sued by my partner who was a rear passenger in the car I was driving, she effectively using her legal cover to sue me, who was insured as a named driver on her policy!

    My case was handed back to the panel of solicitors who then passed the papers onto another firm to remove the conflict.
