Yes, the insurer will pay for a passenger to sue them (the insurer not the passenger)
1) the solictor pays the insurer in the region of £400 for the privilege
2) conditional funding is much more expensive for an insurer to pay out on than paying fees of an unsuccessful case
In a case like the above where you have the potential for there to be a dispute on liability between the 2 drivers plus in addition to that a passenger suing the 2 drivers then typically the passenger would be appointed a different panel solictor to the driver to remove the conflict of interests.All posts made are simply my own opinions and are neither professional advice nor the opinions of my employers
