    Did you raise a formal complaint with the bank over this matter? If not, all the FOS will do at best at this time is pass your complaint to the bank. If you did, I am really surprised that the formal response was that they could not explain the recent charges on the account, yet didn't remove them either.

    I really do hope so,yes i complained to them (lloyds) on more then one occasion but got the same reply from them and on times iv been in the bank questioning something i seen a message on my account saying i met the terms for Financial hardship but still no help so hope this works. will keep all updated.
  • Good guide thanks, don't think I would meet financial hardship criteria but was wondering if it's worth a try since;

    I had well over enough money to cover the overdrawn amount in a linked saver account.
    I didn't transfer the money across because of family illness.
    I have been a customer for many many yrs and have not incurred bank charges before.
    I persuaded my Husband to join the bank as well and he has been a good customer
    I have an overdraft set up on my second current account which wasn't overdrawn.

  • Thanks, Premier, for your quick and helpful answer. I did ring them and they took off £25 from the original £100 charge. I still think £75 just before Christmas is pretty sadistic of them in the circumstances, but couldn't get them to knock any more off. I've made an official email complaint with all my reasons laid out politely so watch this space.......

    Back in 2007 I tried to claim my bank charges on the 14th of June I filed in a county claims for all my charges to be refunded.

    Can I still claim? can I still get my money back?

    Can someone explain what i need to write on the letter?

  • hi hope someone can help. I have tried to claim bank charges back on behalf of my brother from 2005 onwards amounting to approx £1500. At the time he just muddled along and paid the charges but has recently lost his job and suffered with his health. I have gone down the hardship route but the bank has said they will not consider his claim as at the time of the bank charges he was not suffering financial hardship. At the moment he has no money and is struggling to pay basic bills but it doesnt show in his bank as I am supporting him finacially and keeping the bank charges at bay. Is it worth carrying on and asking the FSO to look into his case. Thanks

    You can refer the case to the FOS. However, even if the FOS agree that your brother is in harship, they will not make a ruling on charges, because banks don't have to refund charges when financial hardship is proven. I would say though, unless you have either had a final response or 8 weeks have passed since your original complaint, you cannot refer to the Ombudsman.

    Historical charges are not something that are banked to be reclaimed later on a rainy day.

    The charges incurred in the past are not adversely affecting his current financial hardship you say he is in. For that reason the bank have refdused to refund them on the basis of financial hardship. It's unlikley the FOS will change this.
