    Even though Ombudsman sided with the bank? Do I go through the same route on MCOL as credit card reclaiming?

    The FOS will not consider claims of unfairness; only a court can decide on that.

    Follow the previously mentioned MSE guide on how to proceed. It's linked to from the article in the OP.

  • sorry i'm hijacking here, i wrote a letter to hsbc regarding charges of around 3k, they said no, i've since tallied it up and for 8 months we were paying from 300 a month, the worst being £375. I'm going to give claiming a go again, should i try the bank again, or just go straight to the fos

    If the Ombudsman has sided with your bank then your only other option would be court but just be aware that there has been little to no success with claims on bank accounts since the court ruling before you start spending on court costs.

    Have you tried reclaiming through the bank before? If so what was the outcome? The FOS will not look at cases until you have gone through the bank's complaint procedure to give them a chance to sort it directly so if you haven't done this already then need to start there.
  • I had a lot of bank charges when I was a student between 2001 - 2003. Can I still try and reclaim these charges or is it too late as it's been over 6 years?

    Have you read the article?

    I'm sure there is a specific question addressed in it over how far back you can claim.

  • How do you claim back charges from Barclays these days? They set up a new system where it wasn't termed as a penalty/fine etc. just some other way of doing it. It's around £23 I believe. Can you still claim back bank charges on these?

    Apologies for not explaining it very well but I'm in work without all my info at hand.

    Please can someone help me.

    I've received a letter from a bank i previously used to bank with (i havent used them for over a year) threatening legal action unless i pay £677.
    I used to use this account when i was with my ex partner and although it was in my name he did have full access to it. This account did not have an overdraft and the few times i applied for one (online and in person) i was turned down as i have a poor credit rating and dont earn enough money to be financially viable for an overdraft (which is what the bank said).
    I split up with my ex and moved out of the house we rented and didnt use the account again.
    My ex has since moved abroad and i have returned back to our previous address and i received the letter demanding the money saying that i owe it in overdraft charges. But i didnt have an overdraft!

    There was a reserve on this account which i think my ex must have gone in to and if thats the case i am happy to pay that amount off. But i dont see how it is fair that the bank are demanding that i pay nearly £700 overdraft charges when they wouldnt even let me have an overdraft, surely thats unresponsible and unreasonable on their part? If it was money from the bank that i had actually received and spent then its fair enough i should pay it back but its just money they are adding on each week for nothing, i havent had this money so why should i pay it back to them? Even if i could afford it which i definitely cant i wouldnt want to give it to them.

    I have since written them a letter using parts of one of your template letters going down the human route as i honestly cant afford to give them this money. I am in financial difficulty as it is and dont earn very much. I sent the original letter in december and didnt hear anything so resent it in the beginning of january stating that i had resent it but as yet havent heard anything.
    Do you think that i have a case against not paying them the money? I have paid some in the past which i dont want refunded, i just cant afford to pay them these charges for money that i didnt even have!

    Im not sure whether this is the right part of the website to post this and apologies if not, but i new on here and really dont know what else to do.

    I have and it doesn't say. I know Barclays changed their policy, or wording or something, so it wasn't classed as a charge. Even though it actually is. I was just wondering if anyone had had any luck claiming off them with this little snide change they made (it was a year or so ago they made it).
