    Any claim won under UTCCR 1999 regulation 5(1) would leave it to the National court to decide how far back that would go. It could be 6 years or it could be back to 2001 or even further back to the onset of the EU Directive which is 1995.
    As Premier has said, there are claims testing some of the arguments in the court system but the banks ARE expected to send in the heavyweight QC's at County Court level to dissuade a further mass reclaiming scenario. In time we will see if this in fact does or does not end the bank charges campaign. It hasn't for me one iota.
    Thanks for the replies pls dont think im been greedy, but did get charges back but only for last 6 years and they knew my circumstances as within days nearly got house repossessed so was in hardship, but bank said could not go back any further or add any interest on!!!

    Hi all,

    here's hoping i can get some advice. I receved this letter from Barclays this morning. First part was "Sorry you're in financial hardship, we'll pass it on to a specialist department for advice and support." blah blah blah!

    "You should have received a letter advising you that we are not upholding your complaint about bank charges ( i did not receive any letter) and will not be refunding any charges. This complaint is now closed."

    Now, some background i applied and filled out the hardship form for £262 near the end of last year just before the court judgement and they duly paid up.

    This reclaim i detailed in a letter and if any thing my hardship has got much worse, a total of £526 over the last 6 months. I KNOW that i qualify on many different aspects of the financial hardship claim. I am disabled, accumulated more than £500 of charges in 6 months. Bailiffs visits for unpaid council tax etc.

    Can someone please tell me what my next step would be? I know i have to fight this but how?

    Absolutely 1000000000% YES.


    Will get onto them and ask for details of my charges since my last claim.

    I asked on phone and they said no and that i'd been refunded previously, though they wasn't sure if I'd been paid as it wasn't updated, i should have said no!

    Would really appreciate a little advice,

    After filling in the financial staetment that natwest sent me and and sending a letter with both the legal and human arguements I received this response from them:

    All hardship realtes to my natwest accounts and hence I did not send off any additional evidence (just account numbers). My income varies greatly from month to month so I just stated an average on the form which they have now said (in their most recent letter) is an understatement of my income. I will write back and explain this to them.

    Besides I did also clearly state in my letter that I was in much worse financial hardship at the time of the majority of these charges than I currently am.

    What I would like some advice on is how to challange their legals arguements (which can be seen above). I could just go through each point and write a kind of made up answer to each, but is there any specific things I can say to contradict their arguements? I don't really know that much about each law.

    Any help much appreciated,

    I`ve just received a reply from firstdirect, as a result of the request I sent relating to bank charges levied against me. Instead of what I was expecting i.e. a few A4 pages I got a box weighing about 5lbs measuring 32cm x 22cm x 25 cm. I think I`d have to employ Ernst & Young for a month or two just to go through it!!!!! Is this a deliberate ploy by my bank to put me off ?? Do I really have to try to trawl through all these documents ? It seems they have sent me all my personal data & documents since 2003...please HELP !!!!

    If you are challenging the charges then you need a much more detailed letter stating every charge you have had and why you are challenging it.
    Furthermore, if you are suffering financial hardship, you HAVE to send in evidence of it. Below this post is a link to the lending code which you may want to read.
