Bank Charges Reclaiming Guide discussion

Hi everyone.
I've been burying my head in the sand about an overdraft have hanging over my head. I've just looked at it and there are a ton of "Overdraft usage" charges on there, are these the sorts of things I can claim back? At the moment I am stuck in a cycle where I pay the interest and thats it!
I bank with lloyds. Any help much appreciated.0 -

It should be noted that you do not claim charges back any more. Effectively, you make the bank aware that you are suffering financial hardship and ask them to consider refunding your charges. The bank will look at your situation, typically asking you a number of questions about your finances. it will at your spending habits etc and then decide if it is willing to offer help. This can be a refund of some of your recent charges. However, they have alternatives, such as suspending future charges/interest and setting up payment plans etc.
All the bank is required to do is consider your situation fairly. So, put your case to them. Remember to state what arrears you have, what bills you are finding it hard to pay. How you got into this situation (e.g. job loss, marriage split etc), how it is restricting your spending etc. As long as you are not luxury spending (mobile phone, sky etc) and they can see you are in hardship, they will usually do something.I am an Independent Financial Adviser (IFA). I have been approached by a company wanting to claim back my bank charges. I know I paid for an account I didn't want. I want to try and claim back these charges myself but don't have any details (statements etc as its some time ago) it is still the current account I have now. I want to know how to find out how long I had the account for in order to complete my complaint letter. Help..0

I guess back in 2008/9 I was informed by my bank (First Direct) I would be charged £10 p/m every time £1300+ wasn't paid in. This never used to be the case. Due to certain expenditures coming out of my wage directly (car, child support etc) most often this was the case. I was never informed of any reason for this charge, e.g. for insurance or other account benefits, it was just a charge. Now seeing all of the talk over reclaims can anyone tell me if the above circumstances would warrant a claim for all of these £10's?

Hi,
I made a complaint to LLoyds Bank regarding bank charges that I believe have been unfair. They have asked me to phone them. Doe anyone have advice as to what they will want to know/ask? Is it a good idea to speak over the phone with them?

Well I have followed the incredibly helpful instructions here and have written to Barclays explaining why I would like the £6K back that they owe me in bank charges - this was just last Monday. I received a very polite phonecall today from them explaining that unfortunately they have looked into my claim and do not find the charges unfair (funny that!!!) They have offered their "financial Assistance" department to contact me to go through my finances. She gave me some guff about the lending code and how they follow the code to the letter and even told me that the banks won the court case where it was stated they didn't have to pay anything back. She did say how sorry she was to read about the car accident that I broke my neck in and that she understood how much that must have impacted on my finances. I was very polite back and thanked her for looking into things for me..... Looks like I am off to follow the Ombudsman route now - bit daunting, but I am massively inspired by all the help and support on here - just thought I would share my story so far....0

The banks won the "unfair charges" court case, you will not get anything back unfortunately and they do not owe you anything - court ruled their charges were legal and fair. The ombudsman has no power to change this - current hardship you might be able to get 6 months or so back (or interest freezes, removal of recent charges erc) assuming you are not living with "luxuries" like eating out, expensive mobile/tv contracts etcSam Vimes' Boots Theory of Socioeconomic Unfairness:

I am not currently in financial hardship but have had a lot of charges on two accounts in the past:
Abbey/Santander - charged me excessive amounts for going over my overdraft limit (including £100 worth in one month, and about £50 for going 2p overdrawn in 2006). At the time I was mostly employed, but was living in my overdraft and had to extend a few times to make ends meet.
Barclays - I don't have the paperwork for this account but I was over my overdraft limit significantly when I was a temp and got charged for this. I also got charged a total of £90 for a bounced cheque.
Is there any point in me reclaiming given my current circumstances are different to those at the time? Or are refunds based on the financial hardship that affected you at the time of the charges?0
