I am about to write to bank about some charges and off to read the material and dig out the statements but i have not yet come accross the answer to my question. Can anyone help?
If you are claiming financial hardship do you get aim for reduced rate for the charges or can you ask for all of it back?
Thanks in advance
Why not ask for all? They can only say no.:)0 -
MoneySavingTrainee wrote: »Hello Moneysavers,
I'm a long time reader of the site but this is the first time I'm posting, today, after finding out that £86 of charges have been taken from my account (taking me over my overdraft limit by £86). I know I am now going to be charged again next month for going over my overdraft limit (?)
I was wondering if anyone could give me some advice.
I believe I have a very strong hardship case against my bank to try to claim back nearly £8000 in charges (incl. interest) a lot of which is due to snowballed charges. I have read and re-read Martins tips but am still a little confused. My account was with Abbey National when all my Charges problems started, but they haven't stopped (unfortunately) since Abbey was taken over by Santander. I have years of Abbey statements filed away and will be writing to Santander for a list of charges but does anyone know if I can claim back charges made by Abbey, from Santander?
any help or success stories would be greatly appreciated.

Make your claim from Santander now. Look at bexgriff's posting above. That should give you some guidance. Hopefully you shouldn't have to wait as long for the reply to your claim though!0 -
Since the OFT test case some positive news at last.

Hi, am new to the boards!
Need a bit of advice really, after reading these threads I have requested the last 6 years bank statements from my bank (ulster bank), they said it would take 2 weeks to arrive, which is fair enough-am not giving up
But last Sat hubby went to lift money from hole-in-wall, there was more money than he thought would be in(not by much) lol so he lifted it, we practically live on the £300 overdraft as my hubby is off work due to an accident, I dont work at the min and we have a 6 month old child. Then we were due money on the Monday, went to lift it and it was gone and we were way over our overdraft, the money hubby had lifted had put us over our overdraft and then the previous week I had paid for car insurance and grocieries by card, the bank are saying it was only lifted on the Monday!!
Dont know if Im on the right board for this but Im going to end up with another charge so I just wanted to know -would it be right that car ins,etc wouldn't be lifted that day if you're paying by card? And how could hubby lift more money than he should if it makes us go over the overdraft limit? Sorry for rambling on but would like some help as this is the 2nd time the bank has done this!!
Many thanks for reading! Hope it makes sense!!0 -
Hi Guys,
I have a couple of questions. Having finally got the information from some of my lenders regarding charges i'm starting to put together my letter to request a refund.
So:
1. Am I right in assuming that I can only request a refund of the charges (plus the 8% interest), I cannot request the interest on the debt ?.
2. How much information is enough when filling out the personal section regarding financial hardship ??. Should I be putting in specific amounts for wages, debts e.t.c. and all the dates when changes occured ?. I have included the dates when made redundant e.t.c. but not put any specific monetry amounts in there.
I've also added that i've come to an agreement with my debtors to repay the debts (interest free) but that my partner is unable to do that (he owes far too much and earns far too little for them to consider any such arrangement). Should I leave this information in ?
Thanks in advance, and thanks to everyone who has contributed already to the forums, they really are a massive help :T0 -
Quote from Govan site, things are looking up a bit:
GLC has settled a claim in full for the refund for overdraft charges with Santander UK plc. The claim was extra-judicially after proceedings had been raised utlising new legal and factual arguments.
Some of these arguments (but not all) are scheduled to be test in the cases of Reid v. Clydesdale Bank plc, and Sharp v. Bank of Scotland plc.
A debate will take at Glasgow Sheriff Court on 2 April 2012 in the case of Reid v. Clydesdale Bank plc, with GLC's Mike Dailly appearing for the pursuer, and Clydesdale's in-house legal team and counsel appearing for the defender.
The case of Sharp v. Bank of Scotland awaits a fresh hearing date.

Santander did not reply within the 40days that they were meant to but i did not see on the guide about following it up with a phone call, instead i sent another letter requesting the information whilst mentioning that it was my second letter. Is it possible to still report them for it?
Also after sending the first letter for all details on open and closed account both at my current and previous addresses, all they have sent is one from my current account. This is not really the account i was looking for. Do i need to report them to the information commisioner for that?0 -
I was wondering if anyone can help. I want to make a claim with my bank as i am currently in financial difficulties and have been charged about 350, which could have gone towards bills that i cant pay.
My question is, should i make a claim now to hopefully get the money back to help me in my current financial situation, or should i wait until they have finished charging me so get it back. If I claim now, can i claim again if they continue to charge my account?
Thanks0 -
I would like to know if there is any point in me attempting to reclaim my bank charges?
Yes I have read all the articles, even the 'am I eligible' section but I'm still confused.
I fell into financial hardship in 2010, meaning I quickly maxed out my overdraft. I'm living off basic income support so not exactly wealthy. I can juuuuuuuust about cover my bills, but I'm never out of my overdraft. Currently about -£1,180 into a £1,200 overdraft. The most I ever have in there is -£900 before bills and living expenses quickly eat it up.
So I have had MANY MANY unarranged overdraft fees over the last year, probably averaging out around 3 or 4 per month. One was a fee for being 97p overdrawn.
Some of them I would say are 'fair'. After all, if I don't have the money then that's my fault that I fell into an unarranged overdraft right? So am I eligible? Is it worth asking them to send me a list of the fees?
I appreciate you get the same questions all the time and it must be dull, but I appreciate any replies thanksHi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
I have sent a letter to my local branch of the TSB stating that due to overdrafts and charges I’m in financial hardship.
That was around the 8th of March.
Should i have sent it somewhere else? Where?
Or should i just wait or resend the same letter??0
