I have had a long standing argument with RBS about charges and fees and interest on an overdraft amount that I didn't dispute. I got into financial difficulty and did all the usual of send out letters to everyone with CCCs's help all of them bar one RBS (although RBS cc did play ball?) helped. RBS kept adding to the debt and despite me offering to add it to my mortgage with them they always said no, right up to they day they took me to court for £3000 ( the £1500 in interest was put on hold due to the high court case) and offered a charge on the house which the judge told em "to late should have taken up the offer sooner, so I continued to pay via CCCS and they kept adding to the debt and I kept on trying to get them to help via various letters and claims on hardship grounds (lots of letters from various debts giving me the run around until I filled in the form for the ombudsman and although he says they did not break the rules they have said that once the £3000 is paid of THATS IT and I think that's a result for me!!!!!!!!!!!!!!!!!!! as its just the amount i said i owed in the first place.

I GOT REPLAY FROM NATWEST BANK ABOUT BANK CHARGES
Thank you for your letter of 29 july addressed to the banks customer response service unit in edinburgh. we have taken over the processing of bussines claims and so please use the above address if you need to communicate with us going forward.
your letter makes claims of " financial harship" but this defence is not aplicable to busisness account holder / claimants.
we will however be happy to look your claim. your letter indicates that you are looking for us to consider a refund of £5821.15 and quotes. " i have attached a full schedule of the charges with this document". However , there was no such breakdown received.
Are you able to let us have this and then we can take things forward for you.
We await you response at your convenience.

This means that you are free to make a claim straight away. The reason for this is that business accounts are covered by Common Law rather than Consumer Law.0 -

I'm not sure what website you were looking at nor what you are attempting to do.
Claims for financial hardship are nothing to do with court action. Even if you are succesful in proving financial hardship applies, you are not guaranteed to receive evn 1p in refund. There is no obligation on the bank to do so, other than to ensure your case was treated in a sympathetic and positive manner.
Since the Supreme Court ruling last Novemeber, there is no reason for any court claim to become stayed. But then again, no one has yet won since then in court using the legal arguements this site now proposes. It may well be that as you are not a consumer in this matter, any laws that are designed to specifically protect consumers won't apply to you.

Today i have called Natwest complain and charges team.
whic is i got phone number them letters send back to me.
they said to me they can give last 6 months bank charges, i dont understand why.
this is the number 0845 3030 456.
if you call this number you can lissen message why natwest bank decide to do.
first they explaining what natwest bank can do about it.
please call that number and you lissen that message they explain very quick. my english not well can catch them.

The story: Claiming for financial difficulty and wrote a 3rd letter to say I was to go to the Ombudsman if they do not pay up. I received a letter from the RBS collections department entitled 'hardship claim appeal'. It starts off as ''In order to complete my review there are some details I need to check with you. Please call 0845 *******.'' Now I have been made redundant recently and the letter is asking me to call up an 0845 number of which everyone knows and costs. I spoke to the overseas so called 'business associate' of which I could not understand and said I would go to the Obudsman to take this further, he said i had the right to do that and that I do qualify for financial hardship. I thought 'great he is going to offer me a payout to help with my debts'. He then came out with the following which I didn't meet one criteria, that i havent had 500 pounds of charges in last 12 months. Please can someone tell me this is a joke? He then said because I did not meet this so called criteria they are not obliged to refund any charges. He said the only thing he could do was to reduce payments on my loan and stop any more charges for the next 6 months. This was not what I was reclaiming for!
He said about the ruling in the supreme court last Novermber ruling the bank charges as not being being unlawful and that they are not obliged to refund charges and have only done it in the past as a gesture of goodwill while the court case was ongoing.
What rubbish...Can someone help with what to do next? Martin, any ideas?0 -
Barclays charges claim
I made a claim for unfair bank charges in September 2007 following the letter links from this website. I got a reply from Barclays informing me that they were waiting for the decision from the FSA, which were in court proceedings to decide if the chrages were fair. Once the "FSA" made the decision that they were fair they wrote to me and told me that it couldnt go any further.
Is this true? Can i go anywhere from here?0 -

You appear to know the answer to that. You already threatened the bank what you would do if they don't pay up.
However, be aware that even if you do prove financial hardship, there is no guarantee of getting even 1p refunded. All the bank are required to do is treat such cases in a sympathetic and positive approach.
The reduction in monthly payments and the stopping of any future charges for 6 months may be considered a fully appropraite response in your case."Now to trolling as a concept. .... FSA ends bank charges claims hold (25 November 2009) :eek:The Financial Services Authority (FSA) has ended the waiver which allows current account providers to suspend bank charges claims.
This comes after the banks today won their test case appeal on charges in the Supreme Court, which means the Office of Fair Trading does not currently have the power to assess fees for fairness ...

my advice for anyone is dont bother with claiming it causes nothing but stress and its the biggest con after paying 10 pounds to get my bank statements and then sending endless letters and phone calls to the ombudsman costing more money at the end of it all i can say is it doesnt matter if banks do something illegal we as customers have no say at all :mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad:. after two years of trying to claim i wish i never heard of claiming bank charges!!!!!0
