Report Bank Charges successes and failures

  • mmmm not sooo happy today, received a letter from the FOS regarding Santander they do not think the bank treated me unfairly despite my hardship and ill health.

    I need to look deeper into this and respond with any further information. If I hadn't been hospitalised for two months the cycle of charges that I couldn't escape from wouldn't have started with any of the banks

  • Ive been with this bank for ten years or so and have nearly always been in my overdraft just recently (4 months ago) they sent me a letter to let me know they were going to help me by lowering my limit by £80 each month what they didnt say was it would be lowered 4 days before pay day incurring charges and costing me more.
    When i questioned the bank about this i was told that i was selected because of the way ive use my account and nothing could be done.
    Is there anyone who has experienced the same or similar ??? Please help!

    yes i have just gone to one of these no win no fee companies which manage to get my money back but barclays said it was to be payed in to my visa acount the one that i made the claim on now the have dropped my over drat right down and told me i can use my card and im left with a fee topay the company which took it up to be careful :mad:

    My son had mental health problems and, in a few months, got over his authorised overdraft at HBOS by a few hundred pounds. He'd been made redundant, which contributed to his problems and he refused to claim benefits, which made it worse. He refused to answer calls from the bank. The charges piled up, both interest charges and charges for each transaction over his authorised overdraft limit. I tried repeatedly to ask HBOS to give him a respite, but their procedures (and I accept this) would only allow them to discuss the case with me if he'd authorised each particular call. It would often take me two or three weeks of cajoling to get him to do that. In the end, when the HBOS charging system changed to the new £1 / £5 a day one, our only option was to pay £1300 to pay off his overdraft and close the account. It was going to cost £35 a month just to keep the account open! We'd previously paid £700 to bring it within his authorised limit. HBOS offered £105 as a goodwill gesture which we turned down - we went to the Ombudsman to see if we could get more of the charges repaid.
    The adjudicator turned us down on the grounds that (1) a ruling couldn't be based on the idea of fairness, citing the OFT case and (2) the charges weren't an error on the part of the bank and its offere of £105 meant it had acted in a 'positive and sympathetic manner'. What's worse, the bank now claim £70 of that £110 was fees it waived when we closed the account (which they didn't tell us at the time) so now their offer is just £35. I discussed it on the phone with the adjucator who was sympathetic but would only reconsider if we had new information to present. Looks like the end of the story.

    That is not the only way to act on anothers behalf.

    If your son was not so severely incapacitated as to give you his express permission for each call, then he was probably in a fit enough condition to to agree to a power of attorney.

    With this, you could lodge a certified copy with the bank and then you could have whatever access rights that PoA granted.

    (if you just want access to manage that bank account, the bank may have a form you & he could complete rather than a more wide ranging PoA)

    Perhaps a lasting power of attorney would be more appropraite if their was a chance the condition might deteriorate in the future (this needs to be registered)

    Or if he was already so severely mentally incapacitated, you could apply to the Court of Protection to manage his affairs.

    I cleared off Barclays credit card of £39.00 to a nil balance. (I did this early) I then did a balance transfer at 0 percent for 12 months. They are now charging me £1.00 for the £39.00 saying that as I did both in the same month then I incur interest on the £39.00 - even though I cleared it off early before doing the transer. I rang their customer service dept to be told the above & she wasn't prepared to help me. So basically, I am being charged interest each month on a nil balance. Please help:mad:

    This sticky is specifically to report successes or failures with regards to reclaiming bank charges, not discussion of credit card reclaiming issues.

    Hi what do i do nxt, ive been trying to get my bank charges back for nearlly 2 and a half yrs, then it went to the high court then i think we all got told we wouldnt be getting none off our charges back, well is that it is there anythink else i can try ?

    Who gets there bank charges back when there in financial hardship what do have to be hard up, debts etc ?

    hi all very depressed and angry today having received a letter from fos stating they are not upholding my complaint against First Trust Bank - this is in spite of the fact that I had over 5000 in charges and the bank themselves admitted I was in hardship- unbelievable!!! and before anyone posts to nremind me that even if bank recognises hardship they don't have to do anything....don't bother!!! having studied the posts on here it seems inmajority of cases FOs are siding with banks so whats the point????
