    im really struggling here guys.. yes ive emailed the Mp but how would i go about calling him for an update?

    also yes of course they have recieved my appeal becuase a letter was sent back to me confirming it and then my benefit was reinstated (it ws stopped when i scored zero on the medical)

    Just call them - you can call their Westminster number or their constituency office, either should be able to give you an update. If you can't find the number let us know who they are and I'll find it for you.

    finally some movement on my case!

    just had a call from a lovely lady at the MP'S office and she found out that my appeal got sent to the tribunal on the 1st march

    i phoned the tribunal service but they said they havent got it yet so i should wait a few days

    they said when thye get it, it can take 3 months to get a hearing

    so by the time im 26 (in june lol) i should get my results

    alot can happen to a person in 9 months from the first medical, they could fully recover then esa wont have to backdate! they are really clever arent they!

    Glad to hear that you have some news ilovecows.

    With regard to the backdating, the appeal will look at how you were at the time of the original decision, not now. If someone has now fully recovered, they should no longer be claiming ESA, but a successful appeal would mean that they would receive the additional monies for the period that they were still unwell.

    I think they do have to backdate.

    The appeal is against the decision made at the time and not based on how you are now. If they decide the wrong decision was made they have to put you back in the position you would have been in had the correct decision been made.
