Thanks for that, but in my case they are refusing. Yes ESA50 sent and received and went to medical. Maybe it has something to do with the fact that when I received the decision I was so damn angry that I told them where they should put the claim - as far up as possible! I withdrew the claim made at the end of Jan. I have appealed about the way the points have been given by the doctor

We had a letter (from our MP) asking for further information within the week and that was delivered by post so the response was pretty quick, another letter the following week with a copy of a letter from the DWP to our MP saying they were looking in to my husbands claim, third letter again a week later saying he was having a case revision and that last letter confirmed that his case had been revised and he was in the support group and asking us if we needed any further help at present we should let him know and he was keeping our details so if we needed him in future just let him know.
We rang the DWP after the final letter but thay didnt have a clue about the revision, it took them much longer to send out a letter but knowing it was sorted out was such a relief it didnt matter.
All sorted in under a month and I am very impressed with what he did, we gave him the information the DWP should have read properly at his medical and saved a very sick man from wasting the energy he needs to get through this crisis.
Your MP need to know your name, DOB, address, NI number, what the problem is and they need all the evidence that you have collected for your appeal, from your GP, specialist and anyone else involved in your care including (for instance) people like the practise nurse if you are having regular injections, any information like this can give the DWP a better overview of your illness to make the right decion on your case.
We didnt have a problem getting the assessment rate while appealing, we just filled in the appeal form and his ESA payments continued as they had been.0 -
I am so pleased everything went well for you, I know how it feels to think you have to climb a mountain to achieve what is rightfully yours.
There are a couple of bits of advice I need.
1. Did you have any help filling in the appeal form?
2. Where and how do you get the medical reports from? Do you just ask the Consultant and/or the GP?
To be honest I thought the DWP would have done all of that after I listed all the people on the ESA50 that look after me.
As regards the rest, I seem to have a useless MP - Mr Michael Howard.

i contacted esa and they said that my appeal wont be the tribunals yet... (so ive been wasting my time ringing them!!)...and thats only if they turn it down.... they said that if they do turn it down then i will have to go to tribunal however, esa is not paid whilst at tribunal stage....
this sounds incorrect to me?
well its been 6 months and all they are saying is wait a bit longer!
and guys i dont care who can spell or not all i need is advice!!
and ASAP!

If you are appealing an ESA decision you can be paid the assessment rate whilst you are waiting for the appeal.
As has been said it should have been passed on to the Tribunals Service by now.0 -
healy is correct on both points. It sounds like your case is still at reconsideration stage, which is not acceptable after such a length of time.
I really would be letting your MP deal with this on your behalf.Gone ... or have I?0 -
ok so still no news, not even from the MP and its has been just over 6 months since my esa appeal...
i am thinking of goin back to work as i now feel its time to try again however i dont suppose my benefit will get backdated if i sign off ESA?
if i win my appeal then id be owed 34 weeks of esa backdate which is about £867...
but if i go back to work beofre my appeal is over will i lose all of this money?
i just want my ESA results arghhhhhhhhhh0 -

Do you know where your appeal forms are?
I ask this because about 6 months ago we had the postal strike and my ESA50 (the medical form to fill out before seeing someone) and the severe disability form was sent back to them, they claimed never to have recieved the severe disability form, but the did send me another, which they did receive, I can only assume i scored something on the ESA50 to pass the medical as my money went up, but never heard or saw anyone.
I had to do all the chasing, and i am just wondering did they receive it at all? Have you had confirmation that someone has received your forms.0 -
If you wish to return to work, you can still continue with the appeal process, and if you were successful the additional money would be awarded for the period that you had continued to claim ESA.
Have you contacted your MP for an update?Gone ... or have I?0
