Thanks for the clarification.
So, what we are saying is that if the system gets it wrong and fails somebody who eventually wins on appeal what happens to them in the meantime (maybe 9 months) is just tough?

Yes that is about it, though the rate paid is the same as if they were on JSA.0 -
Previously people were paid a reduced rate of Income Support while appealing an IB disallowance. Under ESA that anomaly is removed from ESA where you get paid the full assessment phase rate.
One of the fairly positive things to happen and people still complain.
EDIT: Also, ESA(C) claimants can appeal and receive that while the appeal is heard, IB would have disallowed and Income Support would not have paid on appeal.0 -

i have phoned the tribunal service and they still do not have my appeal in there hands!
it has been over 6 months and even they said they should have received it by now
the BDC dont have any details either!
someone must know surely?

I "failed" my extremley flawed medical for ESA in November and I appealed straight away, and I receive now the assessment rate of £64 I am now waiting for appeal DWP's descision maker could not overturn the original descision of not meeting the criterea of ESA i got 0 points!
I am now waiting for an appeal tribunal and have got my MP involved but not holding out much hope.. I get the feeling I might end up being pushed out to work when I am just not ready... Oh well JCP website here I come.

I got my result back from my medical today, jsut so happens I had a doctors appointment as well.
They said 0 for everything. MY doctor thought this was highly amusing and also she was sent a letter by them saying do not give this patient any more sicknotes as he does not need them unless his condition becomes worse. It has. I may have felt ready to do something like permitted work something less then 16 hours idealy 8 or so but after the suffering this letter has caused me it is clear I was not really ready for that. My doctor agreed with this and made a point to note down on sick note "severe depression - Worsened"
She has also told me to goto the CAB to appeal for various reasons and she jotted down were she thinks there scorng method is completly wrong and I should have scored something above 0. Also on the basis that in there letter to me they stated thay had asked doctor for a report yet she recieved no request and did not provide them with a report. So they lied. Makes you wonder were else they have lied in this whole "medical descion" or bent the truth to meet certain criteria.
I think I will write to the MP as well some of m actions after recieving my "failed" letter this morning might make for some enlightning reading.
The one thing I am worried about is that they said they sent a letter out 3 days ago as well concerning this and I am unsure how long I have to apeal as the letter I recieved ths morning did not even mention the possibility of apeal0 -
I would be asking your MP to intervene now. Whilst a wait of six months may be acceptable if it was in the Tribunals system, the fact that it has not reached that stage yet is unacceptable.Gone ... or have I?0

Besides I have mild Dyslexia and Dysgraphia, done all the tests and I get extra time in exams to compensate for this. I usually go over what I write looking for these issues and not normal spelling mistakes, such as typing 'n' and 'g' the wrong way round in words ending in 'ing'
Want to lay into me for any of my other illnesses or disabilities, there are a few nasty ones to do with depression you may find amusing for yourself0 -

I actually agreed with someone else who had pointed it out first. I had made one mistake the person I was commenting on had made numerous mistakes, there is a difference.
As you claim to have problems I am surprised you felt the need to lower yourself to be critical of me.
I am not the least bit interested in your other illnesses and disabilities and I did not lay into you and I am not looking to amuse myself as far as you are concerned so do not go for the sympathy vote.0 -

maybe I should have though my question was more tagged onto the end of a agreement with another poster about the ESA system, rather then a question I had thought of and decided to post about.
If you are going to monitor threads maybe you should keep your consistency and not tell one person to make a new thread yet add a thanks to a troll post for someone waiting to make a comment about a completly different thread.0
